Bashar al-Assad and the UNHRC Inquiry

G'day Ilenart626. I'm writing here, because this is not directly on-topic.

I had a quick look at the two ABC references that you used in the Ukraine war crimes article. This one makes the rather dubious claim that However, in Syria, Bashar al-Assad and senior defence leaders have been convicted of war crimes but remain in power. If you're a twitterer and if Tracey Shelton (the author) is a twitterer (or if you're both in the free world of the Fediverse instead of in a walled garden), then you might want to start up a conversation to convince her to be a lot more careful next time. Shelton is devaluing the significance of a legal arrest warrant or legal conviction (her word) against a head of state or head of government.

If al-Assad had been convicted, then I would expect that we would have heard a lot more about it. En.Wikipedia doesn't have any WP:RS supporting Shelton's claim:

• Independent International Commission of Inquiry on the Syrian Arab Republic is presumably trying to convict al-Assad, and the article would be worth updating even if there are no convictions yet
• Bashar al-Assad#War crimes lists lots of investigations and legal cases heading towards al-Assad, but nothing about a conviction; again, updates would be useful

The closest analogy to Shelton's dubious claim is that of Omar al-Bashir#International Criminal Court, who the compromise semi-junta, semi-civilian government of Sudan repeatedly promised to send to The Hague, but now with the junta running Sudan again, this is unlikely to happen until (I'm being optimistic) the junta give up power to the sustained long-term civil disobedience movement. Al-Bashir is subject to an ICC arrest warrant, but has not yet been convicted. I don't think that conviction in absentia is normally allowed at the ICC. Boud (talk) 13:55, 16 March 2022 (UTC)
