Orphaned non-free image File:Craig Lindsay and the Calvine UFO Photograph.jpg

The image description page currently specifies that the image is non-free and may only be used on Wikipedia under a claim of fair use. However, the image is currently not used in any articles on Wikipedia. If the image was previously in an article, please go to the article and see why it was removed. You may add it back if you think that that will be useful. However, please note that images for which a replacement could be created are not acceptable for use on Wikipedia (see our policy for non-free media).

However, I think that the way it is being used fails the first non-free content criterion. This criterion states that files used under claims of non-free use may have no free equivalent; in other words, if the file could be adequately covered by a freely-licensed file or by text alone, then it may not be used on Wikipedia. If you believe this file is not replaceable, please:
- Go to the file description page and add the text
{{Di-replaceable non-free use disputed|<your reason>}}
below the original replaceable non-free use template, replacing<your reason>
with a short explanation of why the file is not replaceable. - On the file's talk page, write a full explanation of why you believe the file is not replaceable.
Alternatively, you can also choose to replace this non-free media item by finding freely licensed media of the same subject, requesting that the copyright holder release this (or similar) media under a free license, or by creating new media yourself (for example, by taking your own photograph of the subject).
If you have uploaded other non-free media, consider checking that you have specified how these media fully satisfy our non-free content criteria. - Hi - I have followed your advice and added a reason and argument for non-free use as directed - I hope this provides sufficient information for this image to be sued in this manner - there really is no replacement free image available to convey this historic event (the first sight of the calvine print for over 32 years). - You can't use it. I don't know what's unclear about that. The individual's role in the event is adequately explained by text; there is no need to add an image to that, so ultimately, the image fails WP:NFCC, specifically #1 (and by extension #8, since any unnecessary nonfree media is decorative.) The use of nonfree media is heavily restricted, since Wikipedia is a free content project. The use of the UFO image, yes, that's clearly justifiable, since that couldn't be adequately described by text alone; showing the reader what the image actually looks like adds something text just cannot. But not so for a picture of a person holding up that same photo, there's just no way that could ever pass NFCC. Seraphimblade Talk to me 00:09, 30 October 2024 (UTC)
- Hi - The modifications I made following your last message were based on your advice and the information you referred me to. I read the criteria carefully and believed it did meet them which is why I took the time to write and post an explanation as you suggested. Your most recent reply makes it clear that I am mistaken.
- I believe this image portays a historic moment which in a manner that text alone cannot convey - it is not simply decorative. It provides a level of information and understanding that the text can't. We see the only original witness with the only exisiting photo of the unidentified craft at the VERY moment he publicly reveals it after 32 years, we see him carefully holding the print so as not to reveal the name he is keeping secret on the rear... we can see his hesitancy, reluctance and slight unease at what he is doing...
- However if this is how 'Non-Free' works on Wikipedea and this image fails to qualify then as a newcomer I'll obviously take your advice on this matter.
- Can I ask - isn't there a way the image can be used if the copyright holder has given permission for it to be used on Wikipedea in this manner (whilst retaining his copyright) - as he has? Drewphotoboy (talk) 01:13, 30 October 2024 (UTC)
- No, that makes no difference. Any media with "use on Wikipedia only", "educational use only", "noncommercial use only", "no derivatives", etc., are still nonfree licenses, and for purposes here are no different from "All rights reserved". Now, of course, if the photographer were willing to release the image under a free license like CC-BY-SA, that would be very different, but you have indicated that they don't want to do that. In that instance, it really doesn't matter if they said "Sure, use it on Wikipedia, but nowhere else". Our goal is free content, which is usable by everyone, everywhere, for every purpose, with no need to ask anyone for permission to do so. Anything short of that is nonfree.
