- Uploader claims this image work as his, but the date he says he took the photo is January 2, 2009, a day after the fire incident had occured (it was in 2009 Bangkok nightclub fire captioned as "Santika Club before fire"). Also, as I search "Club Santika" on Google Images, I find this image as the first image to show up, site claiming to be copyrighted in 2007. staka (T) 03:19, 2 January 2009 (UTC)[reply]

The result of the discussion was: keep. Image size was reduced and since this was not a production vehicle, there is no evidence that a free image could be created. -Nv8200p talk 15:46, 10 January 2009 (UTC)[reply]

- Two problems. 1.) It's not a small image and it's high res. 2.) This image could be recreated/there could be a free version of it available. Undead Warrior (talk) 04:39, 2 January 2009 (UTC)[reply]
- One problem: This image is from a press kit, therefore it was intended for publication. It is a picture of a concept car that no longer exists. This picture is not recreatable nor is there a "free" version. It is over 40 years old. Therefore I believe it does fall under Fair Use guidelines. Manway (talk) 06:39, 2 January 2009 (UTC)[reply]
- Where do you see that the car is no longer available? If it was built, who owns it? Was it destroyed? How do we know that there was not another picture taken by an avid fan who has released it into public domain. But, if this does qualify as a free image already, then I guess nothing needs to be done other than to replace the license. Undead Warrior (talk) 07:25, 2 January 2009 (UTC)[reply]
- The majority of concept cars are destroyed after they have served their purpose. There are a small number that have survived, such as the 1964 Pontiac Banshee, the Corvette Mako Sharks, the 1939 Buick Y-job, just to name a couple. Most of these cars are roadworthy to this day. Truthfully, I can't say for an absolute certainty the car was destroyed. However, I just finished searching Google for images and stories about that concept car, and I feel that if it was still around, it would have been revealed by this time. I am not the uploader, but feel that the article is greatly enhanced by the use of the image, so I'm sticking up for it. Manway (talk) 07:47, 2 January 2009 (UTC)[reply]
- Whether or not the image helps the article is irrelevant. If a free image is available, then a non free image is not to be used. Articles don't need images, but it's a plus to have them. Anyways, if Dodge had this in any type of magazine, or publicized it at all, chances are, someone, somewhere took a snapshot of it. Either way, the first step should be to see if the image is free in itself. Undead Warrior (talk) 08:28, 2 January 2009 (UTC)[reply]

- Comment: I'm not sure a free image could be reasonably created to serve the same purpose. But it definitely needs to be sized down. Stifle (talk) 23:07, 2 January 2009 (UTC)[reply]
- Let me know if it's kept or not. If it is, I will re-size it. Undead Warrior (talk) 17:48, 5 January 2009 (UTC)[reply]
- Comment: Resize will be fine. I still maintain it is an unreplaceable picture. Thank you for not deleting. Manway (talk) 19:29, 5 January 2009 (UTC)[reply]
- Keep. This appears to be the first prototype of the car, as discussed in the article (I've reduced the resolution now). Without the image the text is far less meaningful and, for me, it meets the NFCC#8 terms. Some searching seems to show that the image is not replaceable as noone admits to the object existing anymore - Peripitus (Talk) 01:30, 9 January 2009 (UTC)[reply]

- Fair use is being claimed on this image with the "logo" template. It is not a logo, but, rather, a football coach diagramming an offense. Its purpose is decorative and it is potentially replaceable. B (talk) 13:52, 2 January 2009 (UTC)[reply]
Keep(see below) - It is not replaceable because it illustrates the offensive coordinator for the Arkansas football program at the time that the Wildcat offense was popularized in the college game. (as referenced in the Wildcat offense article) There is no way to go back in time to when the play was popularized and get an image of the offensive staff that was in place at the time, and is therefore not replaceable. It was mistagged as "Infobox" originally; Retagging as "Other" and putting in well-defined purpose. (Note: I would support it being deleted from the David Lee page, as it is very replaceable on that page, but not the Wildcat offense page.) Cardsplayer4life (talk) 03:32, 3 January 2009 (UTC)[reply]
- Also, note that David Lee is referenced twice in the article, both in the college section (as his role as OC of Arkansas) and the NFL section (as his role on the offense of the Miami Dolphins who popularized the offense in the NFL), so it is an important image in the history of the implementation of the offense. (and, non-replaceable, as stated above) Cardsplayer4life (talk) 03:42, 3 January 2009 (UTC)[reply]
- Delete - Color me convinced by the below arguments. As mentioned by Bkell, I think a redrawn diagram would much better illustrate the offense. I will attempt to get to work on one as soon as this image is removed. Sorry for the hassle, guys. Cardsplayer4life (talk) 05:49, 5 January 2009 (UTC)[reply]
- Delete. It's sufficiently not fair use that if it weren't listed here, I'd delete it right now. --Carnildo (talk) 05:16, 3 January 2009 (UTC)[reply]
- Keep - As mentioned, keep for the Wildcat offense article, but remove from the David Lee article. It doesn't seem very replaceable if what is being described happened a few years ago. Next, it is true that the image is irreplaceable in the sense that it is impossible to go back in time and take another photograph of this exact same event, but it is not irreplaceable in the sense required by the non-free content criteria: "Non-free content is used only where no free equivalent is available, or could be created, that would serve the same encyclopedic purpose." It is apparently universally agreed that this image doesn't need to be in the David Lee (quarterback) article; in Wildcat offense, the image is being used to show "Former Arkansas offensive coordinator David Lee diagramming one way to run the Wildcat offense." I see no reason that a redrawn, freely licensed diagram of this offense would not serve the same encyclopedic purpose. (In fact, a redrawn diagram would probably do a better job, since it would be much clearer than this image.) What encyclopedic purpose does it serve to specifically show David Lee himself diagramming this offense while he was the Arkansas offensive coordinator? Nothing that cannot just as easily and effectively be conveyed by text (such as "The offense was first popularized in the college football game by Arkansas," which is already in the image caption and could just be moved to the main body of text). See also the eighth non-free content criterion: "Non-free content is used only if its presence would significantly increase readers' understanding of the topic, and its omission would be detrimental to that understanding." I see no way in which this image satisfies this requirement. —Bkell (talk) 17:21, 3 January 2009 (UTC)[reply]

- Purpose of the image: the article Sidney Lumet is about a movie director and includes detailed descriptions of his directing styles and locations. The article also discusses his directing of this particular movie, "Dog Day Afternoon," and his directing Al Pacino, in N.Y. The image is a photo of this director, directing this same movie, at one of his noted N.Y. locations, and directing Al Pacino. So it's hard to imagine a more useful and relevant image for a Wiki article.

- Keep I don't know about that. Text just wouldn't do this justice, it's one thing to say she wore a revealing outfit and another to actually see that it was two pieces of duct tape and a leather jacket, and I'm not sure how one would obtain a free image from a music video. Beeblebrox (talk) 08:07, 3 January 2009 (UTC)[reply]

- Keep (as uploader). The image's purpose is not to merely depict the band, but to depict the music video for the song. The fact that the screencapture happens to depict the band is inconsequential, as that is not the image's purpose in the article proper. As a screencapture of the music video, I would argue that the image does satisfy fair-use, as it portrays an image of the song's visual accompanyment (or, alternatively, visual interpretation). Just as it would be reasonable to have a music sample in a article/section about a song, I also find it reasonable (and helpful) to include an image in an article/section about a music video. As a visual medium, text alone cannot completely cover the topic of a music video. Drewcifer (talk) 02:49, 3 January 2009 (UTC)[reply]

- Comment maybe I should mention, just in case it's been lost on those not familiar with the band, that the screenshot includes Martin Atkins, a guest drummer who appeared only in this music video. Also, Nine Inch Nails "the band" really only consists of Trent Reznor, the sole member of NIN, and any other "band members" are typically moonlighting with for particular performances (see Nine Inch Nails live performances and List of Nine Inch Nails live-band members for more information on all that). So, I guess I am arguing (in addition to everything above), that a screen shot of the band is very specific snapshot in time, and that the particular configuration depicted never existed elsewhere. Just wanted to mention that. Drewcifer (talk) 02:04, 8 January 2009 (UTC)[reply]

There are bound to be some whose authors have released their works under a free license. But this video would be appropriate in an article about the Canon video. You might be able to make a case for including it in a section about that video in either YouTube or Lim Jeong-hyun but it would be a much weaker claim. The current use is in YouTube#Social impact. I recommend replacing that example with an example for which a free image is available. Recommendation to nominator - withdraw this with the understanding that if this image is still used for this use in a month, you will renominate it. A month should be plenty of time to either find a suitable replacement free-use video that demonstrates the social impact of YouTube, or demonstrate that finding such an example is impractical. davidwr/(talk)/(contribs)/(e-mail) 00:39, 3 January 2009 (UTC)[reply]
- This came as a surprise, because it contradicts what Stifle said here. I take WP:NFCC seriously, and would not have added this image if it seemed likely to fail. The guitar video was chosen to illustrate the "social impact" section, because it is one of the few YouTube videos to have received significant coverage in secondary sources. No doubt an obscure free video that no-one has ever heard of could be found, but this would have little relevance to the article. WP:NFCC is not a god to be worshipped, and should be treated with some common sense.--♦IanMacM♦ (talk to me) 07:58, 3 January 2009 (UTC)[reply]
- You're both right; I got mixed up between this and another image on this matter. I am going to withdraw per davidwr. Stifle (talk) 11:19, 3 January 2009 (UTC)[reply]

Question to the tagger. The image is used in three articles, so does the justification for tagging for deletion apply to all three? And if so, are you aruing that the fair-use justification is insufficient for the same reasons in all three cases? Drewcifer (talk) 02:51, 3 January 2009 (UTC)[reply]

- Image fails NFCC#8 as merely depicting the band without substantially increasing readers' understanding of the article. Removing the image would not be detrimental to that understanding. Speedy tag was removed without addressing the issue. For those who feel the image should be kept, please also confirm whether or not you feel the image should be removed from No Angels as replaceable. Stifle (talk) 23:00, 2 January 2009 (UTC)[reply]
Delete. In this case the screenshot doesnt depict the music video properly and is being used as a band portrait. Archivey (talk) 13:32, 6 January 2009 (UTC)[reply]

- There is currently a dispute as to whether this image, which appears on a website which is explicitly copylefted, is sufficiently freely licensed for use on Wikipedia. I have copied the discussion below from the image page. John254 23:12, 2 January 2009 (UTC)[reply]
- What copyleft terms are being applied here? --Carnildo (talk) 02:19, 2 January 2009 (UTC)[reply]
- Any terms that may reasonably be inferred from the website's statement "Copyleft 2008". Since, per the principle of contra proferentem, vagueness of a contract is resolved against the party who wrote it, where the terms under which content is licensed are vague, the uncertainty is to be resolved in favor of a use of the content which could reasonably be construed as permissible. The type of licensing described in Copyleft#Applying_copyleft might reasonably be understood permit the distribution of this image, the incorporation of the image into a derivative work, the distribution of the derivative work, and use for commercial purposes, rendering the image freely licensed as the term is used on Wikipedia. John254 03:36, 2 January 2009 (UTC)[reply]
- That's not how copyright works. The default assumption for copyright is that all rights are reserved; any changes must be explicitly stated. --Carnildo (talk) 03:40, 2 January 2009 (UTC)[reply]
- The "default assumption for copyright" would only seem to apply when copyrighted content is unaccompanied by any statements which purport to license it. The website on which this image appeared did, however, include a statement which could reasonably be construed as licensing the content: "Copyleft 2008". It would be untenable for the copyright holder to later claim that "Copyleft 2008" should actually have been construed in a manner opposite to its apparent meaning, as effectively equivalent to the "default assumption for copyright" that all rights are reserved. "Copyleft 2008" is presumably included on the website for some higher purpose than merely to serve as a trap for the unwary person who might construe it as affecting the copyrights of the material published there. Since "Copyleft 2008" must mean something, the question of exactly what it means is resolved according to contra proferentem, giving us freely licensed content based on the expected meaning of the term "copyleft". John254 03:59, 2 January 2009 (UTC)[reply]
- Yes, the copyright holder is probably fine with us using it, but we don't know the specific terms involved. For example, are they expecting strong copyleft (where derivative works must also be copyleft), weak copyleft (where derivative works can be under simple copyright), or sharealike (where derivative works must be under the same license)? Is attribution mandatory or optional? We as re-users need to know these things.
- And as a side note, copyright law is not contract law. --Carnildo (talk) 06:00, 2 January 2009 (UTC)[reply]
- We don't "need to know these things" unless we intend to create derivative works under a different license (mere placement of the original image in an article, where clearly separable from such, is not considered derivative), or we intend to use the image without attribution. Since Wikipedia's standards for freely licensed media do not require that either of these things be permissible, we don't need to resolve the question of whether they can be done. John254 23:03, 2 January 2009 (UTC)[reply]
- We do actually need to know these things. Free content for Wikipedia means that derivative works and commercial usage must be possible. Garion96 (talk) 23:20, 2 January 2009 (UTC)[reply]
- While it's true that "Free content for Wikipedia means that derivative works and commercial usage must be possible", this doesn't imply that it needs to be possible to distribute derivative works under some terms other than the original license, or perhaps without any free license at all ("weak copyleft", as described by Carnildo above). Nor do our standards for free content require permission to use the work without attribution (Carnildo asks "Is attribution mandatory or optional?") The terms of licensing for this image that are actually in dispute don't relate to whether it is freely licensed, as we use the term. John254 23:27, 2 January 2009 (UTC)[reply]

- Sorry to butt in here, but wouldn't it be easier to just email Jenna and ask her to release the image under the GFDL than to have this abstruse discussion of what exactly "copyleft" without more means, and contract law, and "contra proferentem". This is getting way too messy :) Kristen Eriksen (talk) 19:17, 2 January 2009 (UTC)[reply]
- Getting permission to use the image under a license other than the one provided on the website would by no means be easy. If the subject and copyright holder were to e-mail a license to me, and I were to therefore place an appropriate license template on the image, certain deletionists could say that they don't believe that I actually received a license. If the subject herself were to create an account and upload the image, allegations could be made that the account was an imposter. The only means by which a new license could be granted that would survive deletionist scrutiny would be via OTRS, assuming that someone with such access is willing to confirm a license for the image. John254 23:03, 2 January 2009 (UTC)[reply]
- Things are usally not that hard. Have you e-mailed them? Garion96 (talk) 23:22, 2 January 2009 (UTC)[reply]
- That would not be advisable until I know that if I were to receive a license via e-mail, my statement that I received the e-mail would constitute sufficient evidence of the existence of the license, in the absence of any evidence to the contrary. Is there a community consensus to that effect? John254 23:35, 2 January 2009 (UTC)[reply]
- It is the way OTRS already works. See the instructions on {{Nothanks-sd}} for instance. "send an e-mail from an address associated with the original publication to permissions-en(at)wikimedia(dot)org". Garion96 (talk) 00:22, 3 January 2009 (UTC)[reply]
- OTRS clearance now only takes a couple of days. If you send in an email and need it cleared expeditiously, send me a talk message or an email quoting the address it was sent from and the subject. It is not a problem. Stifle (talk) 11:37, 3 January 2009 (UTC)[reply]

- Delete until and unless a more specific license is known. CC-by-nc-sa could be considered a copyleft license, but is certainly not accepted here. Stifle (talk) 11:37, 3 January 2009 (UTC)[reply]
- Delete This image isn't a copyright violation, since it's obvious that the original, unaltered image can legally be used in our WP:BLP-complaint article on Jenna Miscavige Hill. Our standards for free content, however, require more: the ability to distribute derivative works, and permission to use the media for commercial purposes. The licenses described in Wikipedia:Image copyright tags/Free licenses have been reviewed with a fine-tooth comb to ensure that they are acceptable for free content on Wikipedia. John254's novel legal analysis on the operation of contra proferentem on a vaguely-worded license, though quite interesting :), is simply no substitute for the deliberative process which precedes the creation of free license template. - The uploader was an unfortunate casualty of the Mantanmoreland affair several years ago so he/she is not available to comment on this image. The description page apparently asserts that the uploader is the author of the image, but it is used in United Evangelical Lutheran Church and Pennsylvania Ministerium as if it is the logo of these organizations. I visited a few ELCA church websites and can't find this logo used anywhere. If it is a real logo, it needs to be sourced and tagged as fair use. If it is a made up logo, it is unencyclopedic.
