Description: In 1964, the New York City Transit Authority (NYCTA) ran a public Subway Map Competition to design a new subway map that would be valid after the opening of the Chrystie Street Connection. R.Raleigh D'Adamo submitted a hand-drawn map that was one of the winners. This map and the accompanying report formed the basis for the use of route colour coding in official New York City subway maps from November 1967 onwards. The original map was destroyed by the NYCTA in the 1980s, but a low-grade colour photograph of the original map was found by D'Adamo in October 2014. Using that photograph as a basis, a reconstruction of the map in vector graphics was made by Reka Komoli during 2014/15 in consultation with Raleigh D'Adamo and historian Peter B. Lloyd. The image here is a low-resolution copy of that copyrighted map. The original design is copyright by R. Raleigh D'Adamo (1964) and the reconstruction by Reka Komoli (1964). Article To Be Used On/Reason For Upload: Article: 'New York City Subway Map'. This image serves to illustrate the historically influential prototype subway map that was drawn by R. Raleigh D'Adamo in 1964. The original hand-drawn map was destroyed in the 1980s. The only extant image of it is a low-grade contemporary photograph, which is too poor to allow design details to be easily discerned. The image that is uploaded here is the only clear representation of the original design that exists. This digital reconstruction is the result of several months' work by Reka Komoli and is copyright by her. A low-resolution copy of her map is uploaded here in order to supplement the article 'New York City Subway Map'. The upload has the permission and full support of Reka Komoli and R. Raleigh D'Adamo.

Rationale for use: 1. No free equivalent exists, or is likely ever to exist. 2. This non-free content is not used in a manner that is likely to replace the original market role of the original copyrighted material. 3. A single, low-resolution copy of the image is sufficient. 4. Comment: I need clarification about exactly what image you want uploaded. I assume you want me to screen capture the image on page 2 of the .pdf file. If that's the case, do you want the entire two images uploaded (both the larger background image and the foreground image on top of it)? Comment: From the Kronberger 61 article:

The nebula is within a relatively small area which is currently being monitored by NASA’s Kepler planet finding mission and the light of the nebula is primarily due to the emissions from doubly-ionized oxygen.

You'll have to excuse my ignorance in this topic area, but I'll need clarification about something to upload this image as fair use. If NASA has a planet-finding mission monitoring this area, how is the following valid in your fair use rationale: "No free image of this planetary nebula exists, and there is no expectation that one will over become available"? NASA's images are Public Domain ({{PD-USGov-NASA}}). How can we say that there is no expectation that NASA will produce a free image? --Nick⁠—⁠^Contact/_Contribs 05:01, 8 September 2015 (UTC)

@Greenzeiger: Do you have evidence to support the claim that it was published before 1923, and what the pre-1923 version looked like? We'd need to verify that it is pre-1923 first of all, and second of all whether the minor variations made since then would qualify for their own copyright, before it could be uploaded with the pre-1923 public domain template. If not, there is no reason why it can't be uploaded as fair use, but we need to wait until the draft is approved first. @NickW557: This page shows a lot of old fezzes from before 1923 which have extremely similar designs on them: Fez Museum: Odd Fellows. The logo was used with minor variation by the predecessor organization since at least the early 1900's.

Proportion: about two thirds of the entire photo, but the original is not commercially exploited by itself and this file is very unlikely to compete with any uses of the original.

Resolution: it is a low resolution, reduced from the original.

Purpose: to show what Monte Davidoff looked like; a free replacement image that serves the same purpose doesn't exist and having a picture, especially from this time period, would add significantly to the article.

Other: from a video presentation at the Museum of History & Industry. Subtitle: ‘And a third person, Monte Davidoff, sat down to lunch and he said he knew floating-point packages.’ (I have removed the subtitle from the picture as it visually distracts from the subject.)

Author/Copyright Holder's Name: the Museum doesn't own the copyright, they're probably exercising their fair use right as well. The ultimate copyright probably lies with Harvard, and Monte Davidoff might have some moral rights, e.g. prohibiting the use of the image as if it depicted someone else, or to imply false endorsement. These rights are very unlikely to be impinged by a Wikipedia article though, and Wikipedia as a rule doesn't shy away from showing images portraying people.

Unfortunately, our guidelines (see WP:NFC#UUI) consider non-free images of living people to be replaceable under almost all circumstances. This is because it is assumed that a freely licensed photo could be taken of the subject, since they're still alive, even if one doesn't already exist. The only exceptions to this are people who are entirely inaccessible (like prisoners), and historic photos of living persons at a younger age when their previous appearance is critical to the understanding of the article. This would be in cases such as actors, whose appearance during their early career is important. In the case of a computer programmer, while it would help to have a photo to illustrate the article, it doesn't make a huge difference whether it's a photo of him now or an old photo, so it would not fall under that exception. The logo you're requesting could be argued to be above the threshold of originality, meaning it is copyrightable. File upload request declined. The file is copyrighted and not free. Wikipedia does not allow fair use images of living persons, because they're considered to be replaceable. This is because someone could take a freely licensed photo of the person instead. Per the email correspondence you linked, "However since this is a copyrighted Walker Art Center image we do not want our images on the Commons." I'm taking this as an indication that they are not willing to release the rights to this image under a free license. Unfortunately, that would be the only way that an image of a living person can be used on Wikipedia. If they change their mind, they can follow the instructions at WP:DONATEIMAGE to do so. I would recommend that you create redirects for the other names for Morton's neuroma, linking to the existing article. Currently, there is only a redirect for the alternative name Morton's metatarsalgia.
