[edit]I have removed the complaint that it is "stating an opinion in a judicial opinion" for the court to suggest that the Kohails should have broken off the fight. In fact, in the law of most jurisdictions with which I am familiar, self-defense is only available as a defense if the defendant could not retreat or was in a special situation in which he had no duty to retreat (such as being in his own home). Unless Saudi law is different in not containing a duty to retreat in a public place, the "opinion" expressed by the court is not a personal opinion but an expression of the law.Bill (talk) 06:12, 23 December 2008 (UTC)

== Facts == This is the verdict announcing Kohail's Sentence together with Muhanna Massoud. This confession was taken under the torture of the Saudi Police. Sultan suffered from a broken leg in custody. Moreover, Muhammad Kohail was mislead by the police telling him if he signed he did punch Monzer in the stomach then he will be let free. Muhamed signs the document, and after that he was told Monzer Passed away. When Mohamed was identifying the person he punshed he pointed at Moneer Haraki not Munzer. But the video clearly shows that Moneer was not fighting at all and many witnesses including the school principal said that Mohammed, Sultan and Muhanna were beating Munzer. Yellow): The statement says: "witnesses agreed unanimously on the beating however disagreed on the tool used". Two points we have to mention: a) The witnesses referred to in the statement were the prosecutor's witnesses. b) Those witnesses do not carry the same version of the story as said in the verdict. This is considered by law a solid ground for a reasonable doubt in such a case. (Blue): Statement clearly says that the reason behind death is the internal bleeding in the bottom of the stomach complicated with the sickness of the heart. This statement is sufficient to change the entire case from a first degree murder case into a manslaughter case. This denies all what has been said about internal bleeding in the brain or anything else. (light green): Kohail and Muhanna have 30 days to appeal.

[edit]This article is a classic case of WP:BLP1E (An article bio who is notable for only one thing) so I'm suggesting moving the article to a new title about the event. The article is already both brothers so I think something like, Kohail Brother Trial or Kohail Trial, Kohail Brother murder case, etc, etc. Anyone have any other ideas? -- Esemono (talk) 13:17, 22 March 2009 (UTC)
International Covenant on Civil and Political Rights
[edit]concerning the comment on violating the "International Covenant on Civil and Political Rights": Saudi Arabia has neither signed nor ratified that treaty, and hence would not breach it. I suggest to remove this part. If one wants to list more treaties that might be violated, candidates would be the Convention against Torture, in case torture allegations during detention are true. Another mention could be the UN resolution "Safeguards guaranteeing protection of the rights of those facing the death penalty", but this only has recommending character, cf. http://en.wikipedia.org/wiki/United_Nations_resolution . To find good wording for these two needs some attention, and would probably be too long for staying in the introduction.Daspostloch (talk) 22:19, 9 April 2010 (UTC)

Lack of clarity
[edit]This article is very confusing. We have the brothers arriving in Canada in 2000, then there is a fight in an unspecified location, in 2007, then they are on trial in Saudi Arabia. Then they are released in Saudi Arabia, but apparently don't go anywhere.
