Trademark matters

[edit]

If the Microsoft page is any indication, Wikipedia does not require that trademarks be identified as such with the use of the superscript "TM". Legally, its presence here is misleading, as this page is not in fact (to my knowledge) a promotional article by or licensed by Brannock. But even if it were, the proper symbol to indicate the status of the mark would be the circled-R denoting federal registration, not the common-law "TM". If Brannock knew of this mislabelling of its mark, the company would be legally obligated to ask that the mark not be labelled with either symbol, lest it appear the company was allowing "naked licensing" to occur, which could endanger the registration. — Preceding unsigned comment added by 66.52.194.23 (talk) 06:57, 20 April 2006 (UTC)[reply]
