The railroad of The Colorado and Southeastern Railroad Company, hereinafter called the carrier, is a single-track standard-gauge steam railroad, located in Colorado. The road consists of two disconnected parts aggregating 7.585 miles. The part operated by the carrier itself extends from a connection with the tracks of The Denver and Rio Grande Railroad Company at Barnes to the end of the line at Delagua, a distance of 6.869 miles. The other part, extending from Chandler Junction to the Denver and Rio Grande Junction, a distance of 0.716 mile, is leased jointly to The Atchison, Topeka and Santa Fe Railway Company and The Denver and Rio Grande Railroad Company. The carrier uses, under trackage rights, the tracks of The Colorado and Southern Railway Company between Ludlow and Trinidad. It also uses terminal facilities at Trinidad owned by The Atchison, Topeka and Santa Fe Railway Company. The carrier wholly owns and uses 16.257 miles of all tracks and wholly owns but does not use 1.206 miles of all tracks. These tracks, consisting of first main track and yard tracks and sidings, are classified in the trackage table in Appendix 1.

CORPORATE HISTORY

The carrier was incorporated August 4, 1909, under the general laws of the State of Colorado, for the stated purpose of constructing and operating a railroad from Trinidad to Florence, Colo., with branch lines. It was organized August 5, 1909. The carrier acquired by purchase the property, rights, and franchises of The Colorado and Southeastern Railway Company, except the latter company's right to exist as a corporation. The Colorado and Southeastern Railway Company was incorporated May 16, 1903, under the general laws of the State of Colorado. Its railroad property was sold August 18, 1909, but the records reviewed indicate that it still maintains its existence as a corporation. A portion of the property which was owned by The Colorado and Southeastern Railway Company was constructed by The Canon de Agua Railroad Company, a predecessor of the Union Pacific, Denver and Gulf Railway Company. The latter company's property was sold under foreclosure and The Colorado and Southern Railway Company acquired the portion formerly owned by The Canon de Agua Railroad Company and sold a part thereof to The Colorado and Southeastern Railway Company.

DEVELOPMENT OF FIXED PHYSICAL PROPERTY

The owned mileage of the carrier, 7.585 miles, was all acquired by purchase from The Colorado and Southeastern Railway Company. The years when the various portions of the line were constructed and the manner in which the carrier acquired the property are indicated in the following table:
