Image is a publicity shot, as fox.com is not a source for publicity shot (their "terms of use" forbids the reuse of the site's image). This image's market role is to add value to the copyright holder's website (and maybe to the websites of its partners) and our use is commpetitive with this (i.e., it's not just about retagging the image to something else). Keep This is an historical photograph. This specific subject no longer exists per FUC#1. Image is a promotional photograph, intended for wide distribution as publicity. Such photos are distributed for reuse by the media with implicit license for their use in discussing the subject that is being promoted. This is an image that is useful and has no available free substitute. Fair use images can be distributed freely. No, this image is not "a promotional photograph, intended for wide distribution as publicity". Fox.com Terms of use explicitly says:

"All materials contained in this Site are protected by international trademark and copyright laws and must only be used for personal, non-commercial purposes"
"The reproduction, duplication, distribution (including by way of email, facsimile or other electronic means), publication, modification, copying or transmission of material from this Site is strictly prohibited unless you have obtained the prior written consent of FOX..."
"The material covered by this prohibition includes, without limitation, any text, graphics, logos, photographs, audio or video material or stills from audiovisual material available on this Site."

Images like this one is what gives Fox.com website an advantage over other non-official websites about Fox's tv-series. Our use of this image undermines this advantage. --Abu badali ^(talk) 18:37, 4 April 2007 (UTC)[reply]
