Uploaded by User:Jessica93. I have a number of concerns about this image. I just... it's listed as freed up under Creative Commons, but something about it just feels a little fishy, and I'm not sure I believe the license tag... for one thing, uploading it was the first action by User:Jessica93, who has not exactly gone on to have a stellar career... it looks like a studio shot, and these are seldom released into the public domain... Hmmm so what do you do when an image is properly licensed but you just don't believe it? Enh, I'm not sure we really want this picture anyway, but if we do, it needs to have a ticket number. I know there's a procedure to get a ticket number, but how do I check to see if a file has a ticket number? Anyone? Thx. Herostratus 04:13, 30 November 2006 (UTC)[reply]

I have uploaded the image with the permission of the author. You should email the address listed below the image for more details. I think that it is one of the best images that I have seen of children. --Jessica93 15:53, 30 November 2006 (UTC)[reply]

Just having permission does not make the image sufficiently free. The copyright holder needs to release the image under an acceptable "free" license. I can't put it any better than User:Howcheng‎ - it's "free" as in speech, not "free" as in drinks. The copyright holder needs to not only grant you permission to upload the image, but also release the image itself under the GFDL or another acceptable license, allowing anyone (not just Wikipedia) to use the image for any reason. Unless you can demonstrate that the copyright holder has done that, the image needs to be deleted. As there are gracious plenty unquestionably free pictures of children on commons, I would err on the side of caution and suggest delete. Also, I don't know the laws, but I would think that not only the studio, but also the child's parents would have to in some fashion agree to let the image be used. Keep, changing PD to fair use is a solution enough. And the original copyright holder went out of business 30 years ago anyway...-- Piotr Konieczny aka Prokonsul Piotrus | talk  20:34, 30 November 2006 (UTC)[reply]
This is a misuse of fair use. The image is a political cartoon and is not indispensable for the article about a historical event, not about the cartoon itself, neither about the author. `'mikkanarxi 22:18, 30 November 2006 (UTC)[reply]
Why? The article has quite a few pics of the Soviet propaganda about this event. This is I believe the only example of the contemporary 'Western/Polish propaganda' of this event. This is a very nice and irreplacable illustration for this historical event.-- Piotr Konieczny aka Prokonsul Piotrus | talk  21:51, 5 December 2006 (UTC)[reply]
Deleted. In order to be proper fair use, the article must discuss this cartoon in particular and its impact/relevance. It can't be used as an example of such propaganda. howcheng {chat} 00:56, 12 December 2006 (UTC)[reply]
Undeleted; the article discusses the cartoon in particular, it is mentioned as an example of Western condemnation of this invasion. It is much more relevant and important than the map above.-- Piotr Konieczny aka Prokonsul Piotrus | talk  06:59, 12 December 2006 (UTC)[reply]
No it doesn't. The caption in Soviet invasion of Poland (1939) reads:
"The stab in the back": Dziennik Chicagowski Chicago Daily The Polish Daily News, September 19, 1939 shows how this invasion was condemned by Western public opinion.
...which is using this as an example of how the invasion was condemned. You have to discuss this specific cartoon, something like, "The cartoon 'The stab in the back' set off a public outcry due to its use of such-and-such imagery which caused many people to associate it with some other thing." In other words, without the inclusion of the image, it would be far more difficult to understand the text -- for example, the Vanity Fair magazine cover of Demi Moore in which she appeared naked and pregnant, or the Billy Ripken baseball card scandal. All the article has to say right now is, "The invasion was condemned by Western opinion, with editorial cartoons appearing in newspapers all around the country." I don't actually need to see one to understand this concept. So again, it's deleted. If you disagree, please don't wheel war with me; take it WP:DRV instead. howcheng {chat} 17:45, 12 December 2006 (UTC)[reply]
