- Reason
- Valuable and uncommon picture from the set of the film "The Delta Force" (1986), kindly contributed by the official stills photographer of the movie: Yoni S. Hamenahem. Very high EV and quality seems acceptable for 1986. I also added an alt version - a downsampled one, in which the zoom view is more pleasant.

- Comment A bit concerned with the copyright here. It is possible (almost likely) that the photographer may not own the copyright if this picture was taken in the US and it was taken as part of his job, as that would be work for hire, in which case the copyright owner would be the studio or whomever Hamenahem was working for. Could someone with OTRS access log in and fill us in with what is in there? --WingtipvorteX PTT ∅ 22:56, 2 July 2013 (UTC)
- I agree, this is very likely a work for hire. — raekyt 23:48, 2 July 2013 (UTC)
- The OTRS ticket is in Hebrew, and it is a forwarded message from Yoni S. Hamenahem. Armbrust The Homunculus 07:40, 3 July 2013 (UTC)
- I asked Hanay from Hebrew Wikipedia about the OTRS ticket, and she said that the mail sent by Yoni Hamenahem was in the standard form of OTRS (the Hebrew translation of Commons:Email templates#Declaration of consent for all inquiries). Tomer T (talk) 15:28, 3 July 2013 (UTC)
- Heres the image in an image gallery dated in 2012 before it was uploaded.... [1]. — raekyt 21:06, 6 July 2013 (UTC)
- Which comes to imply...? Tomer T (talk) 04:35, 7 July 2013 (UTC)
- That the image obviously has been out there before it was uploaded here, that it appears to be a studio promo still (high quality, hes in uniform on set acting, closeup) and that a very basic blanket OTRS here may not be enough to prove he's the copyright holder and not the studio. — raekyt 20:06, 9 July 2013 (UTC)
- As I said below, this was not shot in the US, but in Israel, in which the copyright rules are different. The studios need to prove they're the copyright holders, if they want to claim that. And of course it was out there - as I said in the nomination itself, Menachem was the official stills photographer of the film, and obviously his work was published as promotional. Suspended for OTRS checkAdam Cuerden (talk) 13:38, 8 July 2013 (UTC)- I've brought up the discussion here commons:Commons:OTRS/Noticeboard#Possible_.22work_for_hire.22_and_thus_OTRS_not_valid.3F since I think it's pretty clear he was an employee of the studio for this film, thus this is a work for hire. — raekyt 22:50, 9 July 2013 (UTC)
- I asked Tzahy Lerner, who uploaded the photo, and he said that the film was photographed in Israel (actually, it was the whole time written in the article, but I didn't think of checking it). According to the Israeli copyright law (section 35 a) it seems Yoni Hamenachem is indeed the copyright holder. Tomer T (talk) 19:05, 8 July 2013 (UTC)
- Excellent work Tomer. As far as I'm concerned now, it is up to Hamenachem's employer at the time to prove they had an agreement to own the copyright. I suggest de-suspending this nom.--WingtipvorteX PTT ∅ 20:16, 8 July 2013 (UTC)
- Thanks. Desuspended. Tomer T (talk) 04:32, 9 July 2013 (UTC)
- Section 34 is the relevant part, work for hire. — raekyt 20:07, 9 July 2013 (UTC)
- No, it's not, because he was not an employee of the studios. Tomer T (talk) 20:18, 9 July 2013 (UTC)
- And you know this because? According to an article here http://he.wikipedia.org/wiki/%D7%99%D7%95%D7%A0%D7%99_%D7%94%D7%9E%D7%A0%D7%97%D7%9D he was involved in the production of this film and many others arround the time... so where do you assume he wasn't an employee of the studio or someone connected or wasn't entirely freelance and not an employee when this photograph was made? — raekyt 21:59, 9 July 2013 (UTC)
- He's listed as a still photographer on the IMDB for this movie: http://www.imdb.com/title/tt0090927/fullcredits?ref_=tt_cl_sm#cast so... yes.. he probably DOES NOT own the copyright to this image... — raekyt 22:08, 9 July 2013 (UTC)
- I asked Tzahy Lerner, who wrote the article about Menachem in Hebrew after he interviewed him (and uploaded the photo), and he said that Menachem worked as a freelancer and was not an employee of the studios. Tomer T (talk) 09:48, 10 July 2013 (UTC)
- That's not enough to satisfy OTRS here... IF he's listed in the credits of the movie there WILL have to be a release or statement from the studio to that effect... — raekyt 13:14, 10 July 2013 (UTC)
- I suggest we, once again, suspend the nom until the commons discussion makes a determination on the copyright. --WingtipvorteX PTT ∅ 15:05, 10 July 2013 (UTC)

- Unhappy Oppose - We need to confirm that the OTRS submitter actually has the rights before we promote this, otherwise we all face the danger of Norris' beard-fist pummeling a can of mountain dew through our walkers. — Crisco 1492 (talk) 07:11, 10 July 2013 (UTC)
