East German copyright law
[edit]Hi! I ran into your user page and found the section about the copyright of East German works, and looked it up a bit, because why not. 🙂 What I’ve found:
- The copyright law of the Federal Republic applies retrospectively to East German works, even if their copyright has already expired by that time in the GDR (Anlage I Kap III E II Nummer 2. § 1 Abs. (1) EinigVtr).
- While the journals may be press releases according to § 87f Abs. (1) UrhG, as far as I understand these are additional protections, they don’t replace the usual copyright—this section always states rights of publishers (Rechte des Presseverlegers), not copyright (Urheberrecht).
- The copyright is not transferable (except after death) (§ 29 Abs. (1) UrhG), only usage can be allowed. This means that an organization can never be the author/copyright owner, it’s always the natural person who created it. In case the work is anonymous or pseudonymous, the 70 years apply from the first publication (§ 66 Abs. (1) UrhG).
All in all, copyrights of a photograph taken in the 1960s are certainly not yet expired according to German law, since neither the first publication nor the death of the author could have happened in or before 1951. 🙁 —Tacsipacsi (talk) 14:15, 20 July 2022 (UTC)
