Re photos
[edit]Hi Rachel, and welcome to Wikipedia, although I see your start has hit some bumps in the road.
I am not an admin at Commons, so I cannot restore the images that have been deleted. Trijnstel is a member of the OTRS team so can look at the OTRS ticket. 2012110810001584
I can't speak for Trijnstel, but while waiting for a response, I will offer a couple comments:
There is a backlog at the OTRS site. I can't tell if anyone has looked at your ticket, but I can see that it has not yet been processed.
As I mentioned I cannot see the Commons images - an OTRS pending template is not an absolute bar to removal, but as practice, it is rare for this to happen.
There is no need to upload again, if this can get sorted out, the images can be restored.
One question that will arise is the ownership of the copyright. While you state that the photos were taken with your camera, the copyright generally resides with the photographer, not the camera owner. I've read some cases in which someone directs someone else to take a picture of them with their own camera, but I'll have to reread them again to refresh my recollection of how the law comes down on that, but it is unlikely that will be an issue - I assume you know who took the pictures and can get a release.
In defense of Trijnstel, the photo of you and Dwyane Wade looks like a screenshot. I'm no expert, but I understand why someone would think it is a screenshot.
This will get resolved, I hope you can appreciate that we get hundreds of photos uploaded every day, and many of them are photos not owned by the person uploading them, so we do have to take care.--SPhilbrick(Talk) 22:42, 8 November 2012 (UTC)
- I see that Trijnstel has responded. I've tracked down the editor who deleted the images, and have posted a query.--SPhilbrick(Talk) 22:57, 8 November 2012 (UTC)
Thanks so much to you both I appreciate your patience with someone who needs a little guidance! As you can tell, there are two public figure Rachel Nichols, so my agency has been eager for me to post some photos of myself on my Wikipedia page, for further clarification. In looking at the two of us, you certainly wouldn't think people would get confused on who is who, but you'd be surprised! On some of the shoots we do for ESPN, the producer takes some pictures of the exact setup the camera is going to be positioned in, so we can see what the shot will look like and make modifications without rigging up the entire camera first and then having to shift that around. I have one particular producer who does not have a cameraphone, so I always have him take the pictures on my camera. I can see how these pictures are confused for screenshots, but they are not. In the Dwyane Wade picture you mentioned, he and I are chatting about his Dwyane's kid's basketball skills while we wait for everyone to get set up...definitely not what aired on ESPN :) I assumed since the photos are of me, with my camera, and have solely been in my possession, I have the rights to them. However, I can have the producer who snapped the photos write an addendum release, if necessary. If he does that, how do I submit it in an "attached" way to my previous email, so that whoever is reviewing them can see them together? Obviously, this will be a little time-consuming, so I'd prefer to skip this step, but if it's what's necessary, he'll certainly agree to it and I can try to get him started. - The next step is to hear from the admin who decided to delete the images. Who has just now responded, so I will chat with that person.--SPhilbrick(Talk) 23:28, 8 November 2012 (UTC)
- OK, I'm in conversation with the admin; either that person will undelete the images, and I'll process the permission, or I will re-upload the images and process the permission. --SPhilbrick(Talk) 23:35, 8 November 2012 (UTC)
Thank you very much for the help. It is appreciated!
- A bit of a change in plans - I see that some of the images came from [here]. While you email address convinces me that you are who you say you are, there are some complications. I've tried to arrange to get some photos of basketball players from photographers, and learned that when they are on location, they are bound by agreement with the venue and/or team, and they are not at liberty to provide me with photos, so I have to make arrangements with the copyright holder, who isn't event he photographer. Given the involvement of ESPN, who might have contractual rights to any photos (or not, but I don't know) and given that they were taken by someone else, and in some cases are clearly screenshots, I want to take a deep breath, sort out what can be done, and get back to you. Sorry for the delay, and I won't be able to do more until tomorrow. Remind me to urge to request a cc-by-sa-3.0 license, it will protect you better than public domain.--SPhilbrick(Talk) 00:28, 9 November 2012 (UTC)
