However, I think that the way it is being used fails the first non-free content criterion. This criterion states that files used under claims of fair use may have no free equivalent; in other words, if the file could be adequately covered by a freely-licensed file or by text alone, then it may not be used on Wikipedia. If you believe this file is not replaceable, please:

Panching moved to draftspace

You have commendably created a talk page discussion about the issue, and you have correctly sought help from administrators when the edit war happened. Without your notification at WP:AIV, I wouldn't even have noticed the conflict. If the edit war continues and other editors refuse to discuss, feel free to create a discussion at WP:ANI, to seek community input about the users' behavior.
