Image you uploaded to Commons up for deletion
[edit]Hello -- I revised the article I AM THE BEST ARTIST Rene so that the image link points at Commons, which was you original intention until a later editor uploaded an image to wikipedia and revised the article. Nonetheless, the image you uploaded to commons is up for deletion based on an argument I don't understand. Please see Commons:Commons:Deletion requests/File:IATBAwall.jpg . Let's save this image from deletion
[edit]Hi Penwatchdog. I must apologize for not getting back to you about this image. This image is important, so let try and save it.
There are 2 things at play here.
- You own the copyright to the photograph
- Rene (or his estate) owns the copyright to the artwork.
You have given your permission to use the photograph, so now we need to get Rene's permission (or permission from his estate) to use the artwork.
The easy way
[edit]Probably the easiest way to do this is to send an email to Rene using the email address at his official website and explain the situation. Tell them this;
- You admired Rene's work and took the picture
- You wrote an article for Wikipedia about Rene
- You added the picture and released the photograph under the Creative Commons license CC-BY-SA 3.0
- You'd like them to release the artwork under the Creative Commons license CC-BY-SA 3.0 so it can be used in the Wikipedia article
- They can do this by grabbing the image from http://upload.wikimedia.org/wikipedia/commons/b/bc/IATBAwall.jpg
- Then they need to put that image on their website somewhere and include this sentence "This image is released under the Creative Commons license CC-BY-SA 3.0" next to the image.
I believe this is the easiest solution.
The hard way
[edit]The "official" way is a bit harder. The official way is documented at Wikipedia:Requesting copyright permission and requires Rene (or his estate) to send an email to Wikipedia stating that they release the image under a Creative Common license that we accept. It has to be very specific and include some legal mumbo-jumbo. There are some samples of how to do this at Wikipedia:Example requests for permission.
I think the easy way above is more likely to work, but it's your choice as to which one you want to try. Either way, we need Rene's permission to use the artwork. The Fair-Use way
[edit]I'm adding one more choice here and that is to use the image under Fair-use. For that we have to shrink the image down to 300 pixels wide (i.e. low quality) and write a detailed fair-use rational. This doesn't require us to get permission from anybody. - THANKS for your interest and assistance! this has been really untimely for me, for separate personal reasons, but i've been trying to keep up with it... the Commons administrator who sent the notification has instructed me how to proceed, so i've begun that process on my own. i'm in direct contact with the-best-artist himself and expect his cooperation in confirming his permission with Commons.
- a separate problem i've encountered in the past 24-hours: yesterday a new article i was taking public from my sandbox, in a rush on the computer i inadvertantly mis-directed it to "wikipedia" instead of "article" and now it's disappeared and not coming out in searches. i've notified one other guardian angel to assist but haven't heard back and that angel may be off-line for the weekend... the article is "James Mylne (artist)" and it's ready for public consumption if only i can find it! help if you can and let me know if i can help you in any way!
