Hi M- thanks a lot for your Herzog photo- it's a great picture. Wikimedia Commons has a process called OTRS for establishing permissions to use photos which were obtained by professional or commercial sources. Basically you have the rights holder (maybe Lena Herzog, maybe a marketing company for Herzog) email Commons and tell them that they approve the CC license. Note that you need the current rights-holder, which may not necessarily be the photographer. L. Herzog may have given up her rights to relicense the photograph when it was used to market the film.
