Image without license

Help me!

I have obtained the signed permission (copyright) forms from the artist and photographer--to show the photograph that was deleted from my sandbox page for Hawk Alfredson; how do I get the photo reinserted? Please help me with... Getting the photo (and the signed copyright form) uploaded.

If you have the permission to use the image, it shouldn't be a problem. You just need to use the correct copyright tag for the picture, please see Wikipedia:File copyright tags. Alex ShihTalk 18:51, 1 August 2017 (UTC)[reply]

Thanks for uploading File:Hawk Alfredson, Artist and Painting.jpg. I noticed that this file is being used under a claim of fair use. However, I think that the way it is being used fails the first non-free content criterion. This criterion states that files used under claims of fair use may have no free equivalent; in other words, if the file could be adequately covered by a freely-licensed file or by text alone, then it may not be used on Wikipedia. If you believe this file is not replaceable, please:

  1. Go to the file description page and add the text {{di-replaceable fair use disputed|<your reason>}} below the original replaceable fair use template, replacing <your reason> with a short explanation of why the file is not replaceable.
  2. On the file discussion page, write a full explanation of why you believe the file is not replaceable.

Marchjuly has given much needed information concerning use of this image. However, it's still unclear if I have obtained "a clear and explicit declaration of consent from the photographer" by having her sign a Creative Commons Attribution-ShareAlike 3.0 Unported and GNU Free Documentation license. Please note: the photographer was the artist's wife, and the form I had her sign states that she is the creator of the photograph and by signing the agreement "I acknowledge that by doing so I grant anyone the right to use the work in a commercial product or otherwise, and to modify it according to their needs . . . I am aware that this agreement is not limited to Wikipedia or related sites . . . I am aware that I always retain copyright of my work and retain the right to be attributed in accordance with the license chosen." I also obtained a similar permission from the artist (Hawk Alfredson) since part of one of his paintings is shown in the photograph; it is my understanding that an artist always maintain the copyright on the _image_ that s/he creates. If this procedure and documentation doesn't allow the use of the photograph, would you please give me information about source of a "freely licensed equivalent image." There's really no 100% way for anyone to tell if the licensing documentation you have in your possession is actually OK for Wikipedia/Wikimedia Commons without their actually seeing it. The editors who make such verifications are called OTRS volunteers. So, what you probably need to do is to send copies of all of the documentation you have to WP:Contact OTRS so that a volunteer can verify it. Please take the time to read through c:COM:OTRS for more details on what kinds of information is needed.
There are only so many volunteers and there tend to be lots of requests for verificatoin submitted, but someone will eventually get to it. If, by chance, a file or files are deleted in the meantime, do not panic and try and re-upload them. Files which are deleted are not really gone forever; they are hidden from public view and can be unhidden once their licensing has been verified. Once an email has been sent in, you may add Template:OTRS pending to the file's page. This will let others know that a verification email has been sent in, so that they do not delete the file while it's waiting to be reviewed. Once the email has be entered into the OTRS system, an OTRS volunteer will add Template:OTRS received to the file's page. Files whose licensing has been verified by OTRS will have Template:OTRS permission added to their pages, so that other editors are aware that the file's licensing is OK. If there is a problem with the licensing, then OTRS will not accept the file and let the person emailing them know.
The person emailing OTRS will receive a reply containing an OTRS ticket number. This is sort of like a "case number" and can be used for reference whenever you discuss the file with OTRS. Because of the sometime sensitive information contained in OTRS emails, only OTRS volunteer can typically access them. If you are not the actual person who sends in the email, you may in turn find your access to OTRS information limited out due to privacy concerns; however, if you have any questions about the status of an email, etc., the best thing to do is to ask for assistance at WP:OTRSN.
Finally, please start signing your talk page posts correctly. There's a special way of signing posts on Wikipedia that will add all the required links and time stamps. The easiest way to sign a post is to use 4 tilde as explained at WP:TILDE. If you have any more general questions, please feel free to ask them here. Hello, Leehanson100. Voting in the 2018 Arbitration Committee elections is now open until 23.59 on Sunday, 3 December. All users who registered an account before Sunday, 28 October 2018, made at least 150 mainspace edits before Thursday, 1 November 2018 and are not currently blocked are eligible to vote. Users with alternate accounts may only vote once.

The Arbitration Committee is the panel of editors responsible for conducting the Wikipedia arbitration process. It has the authority to impose binding solutions to disputes between editors, primarily for serious conduct disputes the community has been unable to resolve. This includes the authority to impose site bans, topic bans, editing restrictions, and other measures needed to maintain our editing environment. The arbitration policy describes the Committee's roles and responsibilities in greater detail.
