Image without license

[edit]

Unspecified source/license for File:MacTavish Crest Badge B&W PNG.png

[edit]

Thanks for uploading File:MacTavish Crest Badge B&W PNG.png. The image has been identified as not specifying the copyright status of the image, which is required by Wikipedia's policy on images. Even if you created the image yourself, you still need to release it so Wikipedia can use it. If you don't indicate the copyright status of the image on the image's description page, using an appropriate copyright tag, it may be deleted some time after the next seven days. If you made this image yourself, you can use copyright tags like {{PD-self}} (to release all rights), {{self|cc-by-sa-4.0}} (to require that you be credited), or any tag here - just go to the image, click edit, and add one of those. If you have uploaded other images, please verify that you have provided copyright information for them as well.

For more information on using images, see the following pages:

This is an automated notice by MifterBot. For assistance on the image use policy, see Wikipedia:Media copyright questions. NOTE: Once you correct this, please remove the tag from the image's page. --MifterBot (TalkContribsOwner) 15:46, 21 October 2019 (UTC)[reply]

  • You should probably email WP:OTRS to clear up the licensing. On the one hand, you claim that US copyright has expired. On the other, you claim that the artist has given you permission to use the image on Wikipedia. For copyright to have expired, the individual would have had to have been dead for 70 years; how did y'all know about Wikipedia in the 1940s? —C.Fred (talk) 16:15, 21 October 2019 (UTC)[reply]

Someone cannot "copyright" an image under USA Law. An Image must be TRADEMARKED. There are no COPYRIGHTs on the image in use. WIKIPedia must make the difference between Copyrighting and Trademarking known, or the stance is not valid.

That is not even remotely correct. You said this image was previously deleted, but I only see one upload from you. What account did you use the first time you uploaded it? ST47 (talk) 16:31, 21 October 2019 (UTC)[reply]

Yes the image upload itself had disappeared and the image on the page, as well as the image box in which it was published was edited to remove the image. I used Lachlan 1793, that is my only account. As far as coyrighting and image, that CANNOT BE DONE under USA law. An image must be TRADEMARKED and the trademark must be registed with US Trademark Office in Washington, D.C. The trademarks of the image are expired.

Do not upload the image again until you understand copyright policy. WP:COPYRIGHT and WP:NONFREE is a good start. ST47 (talk) 16:42, 21 October 2019 (UTC)[reply]

ST47 you deleted the image BEFORE I could place the according to WP FLAWED copyright explanation for the image. And YOU are an admin? Holy crap! You are way to eager to undo historic information.

Request reason:

I am a new user, you could have cut me some slack before you blocked me, however I understand why I was blocked. I should not have been rude. But folks, you need to really understand the copyright laws in the USA. I do know them. I am a published author. Simply producing a work, image, text, music, etc. does not mean anyone has a legal copyright. An example is someone posts a written work on the internet simply for information purposes, but does not legally copyright that information, then someone, anyone, comes along and copies that text and sends it to the copyright office as their own work. It is now copyrighted and the thief is now the copyright owner. If no one claims a work, anyone can take it and copyright it, if the author does not take action to protect his work. On the other hand, if a person does not care if his work is copied or not there is NO copyright attached to a work, anyone can use it, or even copyright it. It is then considered PUBLIC DOMAIN if not copyrighted. WIKI policy does not address his situation, which is what I was trying to explain and got shot down. Sorry for being rude, but I got frustrated trying to explain this. I will certainly be more polite in the future, but please do try to understand my frustration, when my edits were repeatedly revoked. Thank you

Decline reason:

Your extremely poor understanding of copyright, Wikipedia's copyright policy, and copyright violations means that unblocking you is a very bad idea, as your edits could put Wikipedia in legal jeopardy. I am declining your request. 331dot (talk) 19:26, 22 October 2019 (UTC)[reply]

If you want to make any further unblock requests, please read the guide to appealing blocks first, then use the {{unblock}} template again. Lachlan 1796 (talk) 18:40, 24 October 2019 (UTC)Lachlan 1796 {unblock} reason : I did not say that I did not understand Wikipedia's stance on copyright. Sorry if I did not make that clear. I have read it four times, just to make sure I did understand. I am a published author and have been in contact with the copyright office before my works were ever published. I am sorry that my view and Wikipedia's do not match. That said, I will abide by Wikipedia's stance, otherwise you the block will continue. My only intent is to provide good, concise, historic information. Wikipeida is great service to readers looking for information and I would not like to jeopardize that effort. I have been a money contributor to Wikipedia, as well. I will use the appropriate tags and/or permissions that may be required according to Wikipedia's policies. I do have a question however. How do I submit permission for an artist's work (as Wikipedia may require) to use his work? I did not see a venue for doing so on the copyright discussion page. Thank you for your consideration. One additional note, one of the admins, selectively removed historic, heraldic information from the infobox on the Clan MacTavish wiki, and now the Clan Members Crest Badge description is incorrect. What is there currently, that I cannot now correct being blocked, is the description of Chief's Crest Badge. I am wondering if the admin does not understand the difference between the two badges, or perhaps, he/she does not understand Scottish heraldry. I would really like to correct the error that is currently showing. Thank you for your consideration}}[reply]

How do I submit permission for an artist's work (as Wikipedia may require) to use his work?
The artist would need to email Wikipedia (or the Wikimedia Commons) to confirm that the material has been donated or otherwise freely licensed for any derivative use, including commercial re-use. The contact point on Wikipedia is the WP:Volunteer Response Team; instructions are on that page on how to email to open a request. —C.Fred (talk) 18:43, 24 October 2019 (UTC)[reply]

Lachlan 1796 (talk) 19:17, 24 October 2019 (UTC) Lachlan 1796 Thank you for this information. It is very much appreciated.[reply]

Lachlan 1796 (talk) 15:12, 26 October 2019 (UTC) Lachlan 1796 | I send an email to Bbb23 explaining why I thought my interpretation of copyright on the Clan MacTavish Crest Badge was accurate, citing WIKIPEDIA sources. I would appreciate a response, please. I am pretty certain I was correct, when I was blocked for disruptive editing, because none would accept my understanding of what WIKIPEDIA sources are saying... the same thing I was trying to explain.[reply]

Don't send me any more e-mail.--Bbb23 (talk) 15:21, 26 October 2019 (UTC)[reply]

Lachlan 1796 (talk) 17:10, 26 October 2019 (UTC) Lachlan 1796 | the only reason I emailed you was because you are the blocking admin, and I was blocked because of another admin's inability to understand Wiki's own rules on copyright, which I quoted for your to preview. You are certainly not being fair to me if you will not even look over what I wrote. It seems you have take a totalitarian approach, by telling me to not send you more emails This is the only venue left open to me to address the block "to you" as I cannot post to your talk page, because you have blocked me indefinitely, which is paramount to a ban. This is really sad.[reply]

There's no reason for you to send me e-mail. For you to continue to challenge Wikipedia's copyright policy is partly what got you blocked in the first place. Unless you have something new to say, I will likely revoke your access to this page. And lose the "totalitarian" rhetoric. That doesn't help you either.--Bbb23 (talk) 17:14, 26 October 2019 (UTC)[reply]

Lachlan 1796 (talk) 17:31, 26 October 2019 (UTC) Lachlan 1796 | so you did not review my email?[reply]

Lachlan 1796 (talk) 17:33, 26 October 2019 (UTC) Lachlan 1796 | I did not challenge the policy, I quoted for you the relevant sections.[reply]
