"Threatening the President of the United States" article

Hi Ferberson, I see that my edit that says this crime is a Class E felony was undone back to a "Class D felony". You said it just barely counts as a class D felony, but I looked at the source for this, and compared it to this table, and based upon my analysis, it's a Class E felony. Can you clarify where you found that it's just barely a class D felony as opposed to a class E one? Thanks. Sam.gov (talk) 20:41, 14 January 2015 (UTC)[reply]

Okay, thanks, but it's just that the source I looked at compared to that table I mentioned earlier said differently. But thanks again for the clarification on this one. Sam.gov (talk) 05:46, 15 January 2015 (UTC)[reply]
Also, class D felonies are in a row of the table that says "5 or more years". I think I understand your thinking now; you have to look at the maximum penalty, not the sentencing range, when looking at that table. Ferberson (talk) 16:41, 15 January 2015 (UTC)[reply]
Exactly, so I am guessing it's appropriate to change it back to a Class E felony then? Sam.gov (talk) 18:29, 15 January 2015 (UTC)[reply]
No, don't do that. The maximum prison term is 5 years, so it falls in the "Less than 10 years but 5 or more years" row, which is class D. Ferberson (talk) 18:49, 15 January 2015 (UTC)[reply]
Well if you say "less than 10 years but 5 or more, then 10 years would be the max term, but if you say max term is 5 years, I believe that means 5 or less years, so that would be a lower class because it is a lower max term. Sam.gov (talk) 19:02, 15 January 2015 (UTC)[reply]
Try asking at the Village Pump or something so we can get a third opinion. Ferberson (talk) 00:48, 16 January 2015 (UTC)[reply]
