Note:Mrs. Kirkpatrick is not on-line. She mailed me the photo of herself for use with the article about her. She said the picture was taken by a paid photographer in 1988. It has no copyright problem.Billy Hathorn (talk) 02:11, 5 October 2008 (UTC)

Image copyrights
Billy, I have seen that the licensing of some of your image uploads have been questioned. Can I offer you a little insight into copyrights? Take, for example, Image:S.S. DeWitt of Tensas Parish, LA.jpg, which you recently uploaded. You state in the "Summary" section that:
The picture is a gift to me from Mrs. Hazel DeWitt for use on Wikipedia. She took the picture, and it is not under copyright
One thing you need to realize is that in the United States (where I presume that this image was taken) the act of creating the image creates a copyright. Mrs. DeWitt has a copyright on the work because as soon as she snapped the shutter button and exposed the film, the copyright was generated. Unlike in the past, the creator of an image — here Mrs. DeWitt — does not need to register a copyright or anything. What Mrs. DeWitt gave you was a print of her copyrighted photo. What she may have intended was to give you permission to use the photo. If so, she needs to explicitly give Wikipedia permission to use the photo, whether or not you own a copy of the photo (even if it's the only one).
So in general, when someone gives you a photo to use, the copyright owner (usually the person who took the photo) must specifically give Wikipedia permission to use it. Copyrights can be very complicated, so this advice probably won't apply in all situations. Hope this helps clarify some of this a little bit. — Bellhalla (talk) 14:42, 6 October 2008 (UTC)
