[edit]On 23 August 2011 Disability Rights Oregon, the Center for Public Representation, Miller Nash LLP and Perkins Coie LLP sent a letter to Oregon Department of Human Services director Erinn Kelley-Siel requesting that the state take steps to move people with disabilities out of sheltered workshops into regular employment.[1]
On 25 January 2012 United Cerebral Palsy Association of Oregon and Southwest Washington filed a class action lawsuit against Oregon Governor John Kitzhaber and top officials at the Oregon Department of Human Services with the U.S. District Court in Portland. Bob Joondeph, the executive director of Disability Rights Oregon, served as the plaintiffs' attorney.[2] Defendants in addition to the governor were Erinn Kelley-Siel, Director of the Oregon Department of Human Services; Mary Lee Fay, Administrator of the Office of Developmental Disability Services; and Stephaine Parrish Taylor, Administrator of the Office of Vocational Rehabilitation Services.
On 29 June 2012 Assistant Attorney General Thomas Perez of the Department of Justice's Civil Rights Devision sent John Kroger, Attorney General for the State of Oregon, a letter detailing the DOJ's findings in the case.[3]
Owing to a criminal investigation Gov. Kitzhaber resigned the governorship effective February 18. He was succeeded by Kate Brown. The case was then renamed to Lane v. Brown.
The settlement agreement was brokered by Magistrate Judge John V. Acosta.
