ABSTRACT

The Article seeks to establish the wickedness of Inkosi Langalibalele Municipality and uThukela (department of water and sanitation).The Inkosi Langalibalele Municipality has sabotaged the constitutional rights of residents enshrined in the constitution. I wish to acknowledge that the act of abusing residents is the culture of Inkosi Langalibalele Municipality and uThukela (department of water and sanitation). It is time to fight these municipalities. In a landmark judgement by the Gauteng High Court, the court mounted pressure to eMalahleni Municipality and the Provincial Government to provide basic services to the residents as enshrined in the constitution. The eBhovini, between Pomeroy and Dundee KZN, Protestors damage the road, demanding service delivery. The Fair-Trade Independent Tobacco Association (Fita) fought the government to unban tobacco. The Gauteng Liquor Forum also fought against the alcohol ban. The Hlathikhulu case weighs much more than the incidences mentioned. Hlathikhulu residents sought the court to mount pressure to the Inkosi Langalibalele Municipality. DISASTER INDUCED BY UTHUKELA (DEPARTMENT OF WATER AND SANITATION)

It is so convenient to hear from the horse’s mouth. This letter thus convinces the Department of Justice and Constitutional Development (Estcourt Magistrate’s Court) to declare the water crisis at Hlathikhulu as a man-made disaster and rule in favor of residents and mount pressure and ban all construction activities carried by Inkosi Langalibalele Municipality and under Inkosi Langalibalele Municipality at large until the community is provided with clean and drinkable, safe and non-stop running water. Hlathikhulu community is experiencing a water crisis induced and perpetuated by uThukela (department of water and sanitation). The Hlathikhulu community has been enduring water crises under the Imbabazane Municipality and uThukela (department of water and sanitation), we regard this crisis as a man-made disaster. The fact is that residents are ailing from the water crisis as they have been out of water for 4 months in 2014, specifically from April to July 2014. This crisis is occasional as the last drop of water came out on the 29th of July 2020, it ran probably 15 hours (refer to Annexure 501A).

Unfolding how the uThukela (department of water and sanitation) sabotaged the constitutional rights of residents. Firstly, Hlathikhulu residents still find themselves sharing water with the geese, dogs, goats and cows (refer to Annexure 502B) while areas surrounding Imbabazane offices are in possession of clean, drinkable, safe and non-stop running water which is found within their yards. Secondly, individuals must boil water before they use it (refer to Annexure 503C (i)). Thirdly, residents are drinking river and borehole water in the midst of the pandemic (corona virus), (refer to Annexure 504D (i)) the reasons are myriad, to clarify this man-made disaster it is wise to acknowledge how Zimbabweans in Zimbabwe suffer a water crisis as Hlathikhulu residents endure a crisis perpetuated by uThukela (department of water and sanitation). Most Hlathikhulu residents are pensioners which makes it hard for them to buy hygienic water (refer to annexure 505E). We would like to acknowledge that areas surrounding Imbabazane offices are in the same category as Hlathikhulu and they don’t pay any services except electricity. Provision of water was worse under Imbabazane Municipality and uThukela (department of water and sanitation) but Inkosi Langalibalele Municipality and uThukela (department of water and sanitation) exacerbated the crisis. Shelembe, et al (2020) assumes that politicians deflect service delivery and take advantage of their position to manipulate and sabotage specific municipality wards.

Case study of Chegutu Municipality conducted by S.Obert, M.Stewart & C.Muchineripi (Chinhoyi University of Technology) was based on five cardinal pillars, which are Local authority, municipality, service delivery, urban governance & Zimbabwe, to reflect and demonstrate service delivery run by Chegutu Municipality. It is wise to reflect on how Chegutu Municipality has abused the Zimbabweans. Hintonvile residents under the Chegutu Municipality’s erratic to no water supply has forced residents to resort to unprotected water sources on leaking municipal water supply pipes and Raffle Range residents access water at a borehole as water supply is erratic. uThukela (department of water and sanitation) has forced residents to resort to boreholes. To be frank, uThukela (department of water and sanitation) has sabotaged the constitutional rights of residents yet it has been relinquished from the measure to combat the pandemic. Some residents in remote areas like Hlathikhulu received water tanks as water comes in a staggered manner. As residents resort to boreholes water from boreholes is insufficient and of questionable quality for domestic purposes hence hygiene at household level is compromised.

While residents in Estcourt (CBD) exposure abuse of uThukela (department of water and sanitation) on social networking, (refer to annexure 507G). However, Hlathikhulu residents opted for the Department of Justice and Constitutional Development (Estcourt Magistrate’s Court) to defend themselves. Water Services Act (Act No.108 of 1997) elaborates the right of access to basic water supply and sanitation. 3. (1) everyone has a right of access to basic water supply and basic sanitation. UThukela (department of water and sanitation) failed to bind and violate the Water Services Act (Act No. 108 of 1997).

GROUND POINTS:

• Ban all construction activities run by inkosi Langalibalele municipality and under the municipality at large until the community is provided with inside yard running tap water.
