From Wikipedia, the free encyclopedia

Brenda Dassey is an American man from Manitowoc County, Wisconsin, who was arrested and convicted for the murder of Wisconsin photographer Teresa Halbach. [1] Brendan Dassey confessed to have committed the murder of Halbach along with his uncle, Steven Avery. [2] Dassey and Avery's trials are the focus of the Netflix original documentary Making a Murderer (2015), a 10-episode series directed by Laura Ricciardi and Moira Demos [3]

Pre Trial

[edit]

Initially, Dassey's lawyers fought to have the confession suppressed. However, after losing the suppression hearing his attorneys worked to have Dassey provide even more details about the murder of Halbach so that Dassey could testify against Avery.[4] Dassey later sought to have his attorney, Len Kachinsky removed , but the judge ruled that Kachinsky was adequately representing Dassey. Dassey later wrote a letter directly to the judge and Kachinsky was then removed as his attorney.

Trial

[edit]

With new counsel for his trial, the prosecution had the majority of Dassey's intial confession played for the jury. Since the release of Making a Murderer, key parts of the video have been posted to YouTube [5] In addition to the initial confession, Dassey's defense team that follow-up interviews with investigators without his initial lawyer, Kachinsky, should not be admitted. [6] While he had new counsel, Dassey was convicted for his part in the murder of Halbach [7]

Post Conviction

[edit]

In 2010, lawyers from the Northwestern University Center for Wrongful Convictions Program filed a post-conviction brief seeking a new trial for Dassey largely based on Kachinsky's ineffective representation. However later that year, Judge Jerome Fox denied Dassey's claim.[8]
