- The article will, of course, include discussion of the district court's opinion [2], and the second circuit's vacation [3] of the district court ruling.
- The courts disagree as to the applicability of 1-800 CONTACTS, INC. v. WhenU. com, Inc. [4]. Exploring the second circuit's opinion requires brief discussion of this case.
- A number of blogs and news articles discuss the Rescuecom cases.[5][6][7][8] I expect their articles to inform the article, particularly with reference to the circuit court decision. In each instance I link here to a representative article discussing the case.
- Complete discussion of arguments made in this case will draw on the various briefs filed by the Electronic Frontier Foundation, AOL, Yahoo!, EBay, Public Citizen, various law professors and the original briefs filed by Google and Rescuecom.[5]
