Alcoholic Beverage Code

The Texas Alcoholic Beverage Code is the statutory law enacted by the Texas state legislature to regulate permitting and licensing for the sale of alcoholic drinks, regulations for the use of alcoholic drinks, and establish the Texas Alcoholic Beverage Commission, which enforces these codes. The code was enacted in 1977 by Texas HB 815, 65th R.S. during the ongoing revision process begun in 1963.

Notable Titles, Chapters, and Statutes

Sec. 2.02: Assesses liability for those who provide alcohol to persons who then go on to damage property or harm people in some capacity.

• This has been litigated a number of times, often times in connection to bars serving alcohol to persons who were visibly intoxicated and ended up driving.

Title 4, Chapter 5: Regulates when alcohol can be sold, with some interesting provisions.

• Sec. 105.01: Prevents the sale of Liquor on New Year's Day, Christmas Day, and Thanksgiving as well as on every Sunday. It is also specified that Liquor cannot be sold from before 10 a.m. and after 9 p.m.
