The Registrar Office of Credit Reporting Agencies is a division under the Ministry of Finance (Malaysia) headed by the Registrar of Credit Reporting Agencies. The Registrar Office reports to the Secretary General of Treasury through the Deputy Secretary General of Treasury (Policy).

The Registrar Office was established on 16 June 2011 via Establishment Warrant No. A115 of 2011 dated 27 June 2011.

It is responsible for protecting the users and the privacy of their credit data through the registration and regulation of credit reporting agencies in Malaysia under the Credit Reporting Agencies Act 2010.

Functions

The functions of the Registrar of Credit Reporting Agencies are contained within the 2010 Act. It has seven main functions:

  • to advise the Minister on all matters in relation to the administration of the Act;
  • to implement and enforce the Act including the formulation of operational policies and procedures;
  • to promote awareness and dissemination of information to the public in relation to the operation of the Act;
  • to be responsible for the monitoring, controlling, supervision and regulation of credit reporting agencies;
  • to encourage and promote the sound and orderly development of credit reporting agencies and the credit reporting sector;
  • to create a conducive environment for credit reporting agencies to carry out their activities; and
  • to carry out such activities or do such things as are necessary, advantageous and proper for the administration of the Act, or such other purposes consistent with the Act as may be directed by the Minister.

Powers

The powers of the Registrar of Credit Reporting Agencies are as follows:

  • shall have all such powers to do all things necessary or expedient for or in connection with the performance of his functions under this Act;
  • to appoint such agents, experts or consultants as he thinks fit to assist him in the performance of his functions;
  • to enter into contracts;
  • to establish and maintain the Register;
  • to collect such fees as may be prescribed under the Act; and
  • to do all such other things as he thinks fit to enable him to perform his functions effectively or which may be incidental to or consequential upon the performance of his functions.
