First true film noir?

It seems that this assertion comes from a film critic, Dennis Schwartz, who self publishes his own film reviews on his personal web site. Hardly a encyclopedic source (for example I could start my own film criticism web site and counter that argument and cite my web site as a source). Also the assertion of it as the first film noir uses weasel words "According to some critics"... some critics? Which critics? Would that be 2 critics out of 3500? This information is cited in the Wikipedia article for Film Noir. Unfortunately, I don't have any of the books myself in order to validate them. I've contacted the person I think added the references to the other article for his input.
