@Shelyric: A reliable source needs to be provided to support any claim that Ellsworth is dead per WP:BLPSOURCES and WP:BDP. If there are any secondary reliable sources (e.g. newspaper articles) that can be cited to verify this, feel free to re-add the content, the image, and make any other revisions deemed necessary (e.g. changes in verb tense, categories). Otherwise, there's no way to support a claim of death or the use of a non-free image. If, however, you can get the copyright holder of File:Scott Ellsworth 1980.JPG to given their WP:CONSENT, the image could possibly be relicensed to something other than non-free content.
