Invalid example removed
[edit]I've removed the text discussing the janitor's failure to clean the floor. This is an example of vicarious liability, not the tort which is the subject of the article. I'll try and put together a better example to replace it. Tevildo (talk) 11:57, 5 January 2014 (UTC)
Absence of evidence as to malice
