In fact, the initial discussions took place on 4 August 1994 in Coen. I chaired the second part of the meeting. In fact, Warren Entsch moved the original motion that started the process.

He took crown law advice that suggested that there was no way you could enshrine into leasehold an ongoing access agreement. Crown law has, in fact, modified its position since those days back in 1996-97. The Keating government supported it. Whilst the Heads of Agreement was supported initially, there has not been substantial reinforcement of that through the current federal government. It has lapsed. The people have held together very well considering that the agreement is now over four years old. If you asked those signatories—those heads from TWS through to the remnants of the Cattlemen’s Union that are now members of
AgForce or members of the Peninsular Cattlemen’s Association and, indeed, from the Cape York Land Council through to ATSIC

It was a year and a half, I think, before they actually brought the NHT—the up to $40 million that had been promised—into play. I think things could have happened a lot faster.

- "Prior to being Chief Executive Officer of the CYPDA, I was Executive Director of the Cattlemen’s Union ofAustralia. During that period, I was involved in the establishment of the Cape York Heads of
Agreement. In fact, I did most of the lead-up work before we pulled in an independent facilitator, Rick Farley, to complete the task of the Heads of Agreement, which, as you know,was signed off in early February 1996. As a result of the Heads of Agreement, both the then government, under the Prime Minister, and the then opposition leader, John Howard, committed up to $40 million to progress that Heads of Agreement
- At that time the CYPDA essentially was not involved in the make-up of the Heads of Agreement, but subsequently endorsed the Heads of Agreement. That was then pursued into stage 2 of CYPLUS. CYPLUS commenced in early 1992. It is now in its third stage
- Stage 2 put together a regional advisory group of 14 members who represented the major constituencies in Cape York. They were tasked with delivering a set of recommendations to both the state and federal governments for implementation into Cape York, to look at initially a
land use study, which then became a land use strategy. It ended up delivering 640 recommendations. I was the chair. In fact, Senator McLucas was one of the members of that committee of CYRAG. Six hundred and forty recommendations went forward to the federal andstate governments. Also, CYRAG itself incorporated the Cape York Heads of Agreement into the stage 2 document
- There is probably more association of the Wik decision with the Heads of Agreement in that it espoused what the Wik decision delivered, and that was coexistence for people on Cape York
- There are some 11 pastoral properties currently involved in the process with the NHT. There were some 58 pastoral properties, members of the Cattlemen’s Union Peninsula branch, that supported the Heads of Agreement in 1996. One of the major problems that had been faced during the process from Mabo through to Wik was the inability of pastoralists to borrow for development of their properties.
