The Chieftaincy of Scots Clans have followed the principle of agnatic seniority since the Middle Ages...this precludes the Earl of Rothes from the Chiefship of the Leslies, as his direct descent is not exclusively in the male line. The surname "Leslie" was merely assumed by a number of Earls Rothes including:
- The 9th (John Hamilton, son of the Earl of Haddington)
- The 13th (George William Evelyn)
- The 16th (George William Gwyther)
- The 19th (Norman Evelyn Leslie, whose father Captain Martin Edward Haworth assumed the surname by Royal licence)
- The Heir presumptive is therefore a Haworth
Needless to say, a female cannot hold the Chiefship of a clan.

[edit]These irish officiers had fought in french army at the beginning of the 18th century[1]. Do they come from the same family ?
- Michaël Lesley, Earl of Rothe (1661-1741), officier irlandais au service de France, colonel du régiment de Rooth (1718-1733), brigadier (1706), maréchal de camp (1710), lieutenant-général (1720).
- Marié à Catherine, fille de Charles, 2nd Earl of Middleton. Dont 1 fils unique :
- Charles Edward Lesley (1710-1766), Earl of Rothe, colonel du régiment de Rothe (1733-1766), brigadier (1743), maréchal de camp (1745), lieutenant-général (1748).
- Marié à Lucie (1728-1802), fille unique de Lucius Henry Cary, 5th vicomte de Falkland.
