New Supreme Court Nomination

Might want to lock this down for a little while. The definition of 'Advice and consent" might become a big debate while we have to deal with nomination a new supreme court justice

Should there be some mention of non-U.S. uses of the phrase "advise and consent"? On http://en.wikipedia.org/wiki/Enacting_formula, I see that the phrase has been used as part of the enacting formula for legislation in the U.K. and other countries that nominally follow the U.K.' queen. I also notice that http://en.wikipedia.org/wiki/Judicial_and_Bar_Council mentions a defunct Phillipine process that sounds like "advice and consent" (and is characterized as such in one of the "Did you know?" questions on today's Wikipedia front page). I'm guessing that some constitutions that follow the U.S. model--and perhaps some others proceeding from different angles--also have advice and consent in nomination processes, but I'm not sure.Hickoryhillster 14:11, 13 August 2006 (UTC)[reply]

For countries where the exact phrase is used, add them under another level two header. Governments that have a similar process, but with a different wording, can be listed under the See also section. Koweja 17:19, 10 November 2006 (UTC)[reply]

Waiver of Advice and Consent?

Just a thought. If the Senate refuses to advise and consent (as opposed to denying consent) could that be construed as a waiver of their rights and the nomination is not blocked? The question is if they have an affirmative duty to confirm rather than a right to deny. Is "not voting" mean a required "yes" is denied, or and optional "no" is not asserted?
