Vacated Wins

Since Alabama is considering appealing the NCAA's decision and the penalty has not yet taken effect, isn't it premature to already be counting these games as vacated? Until a final decision is made, these games should still count as wins. A sentence or two should be enough to explain the status of the the NCAA's decision.
