The episode in question, "Dennō Senshi Porygon", is notable only because of the scene that caused seizures in children; indeed, apart from the first episode, this is the only episode in the show's five-hundred-plus run to be covered in its own Wikipedia article; this alone affords it a prima facie fair use defence. This defence is strengthened by the clip being the subject of its own section, with technical information that partially describes the phenomenon, and the unquestioned cultural impact of the scene: almost killing the franchise, changing animation guidelines in Japan, and being the subject of several American parodies (where the episode was not aired). The possible danger is believed to be low; the accepted medical explanation for the majority of reported cases is mass hysteria, and the low resolution and quality of the clip reduces the risk of seizures. |
