Summary
[edit]A 29-second sample of a rare recording of "You Are My Sunshine" (1939) cover by the Dead Man Street Orchestra (a.k.a. Tuba Skinny). No other recordings of the Dead Man Street Orchestra are easily available. The Dead Man Street Orchestra was the earliest incarnation of Tuba Skinny with the same performers albeit playing on different instruments and with a very different style. This song is significant as it represents one of the earliest examples of the musical style and inchoate talent of a band that would later be described by Offbeat magazine and The Syncopated Times as the most notable traditional jazz band in United States.
- Source: "You Are My Sunshine - Dead Man Street Orchestra
- Performers: Shaye Cohn (accordion), Barnabus Jones (fiddle), Kiowa Wells (guitar), Alynda Segarra (washboard) and Todd Burdick (banjo)
- Songwriters: Jimmie Davis and Charles Mitchell
- Copyright: Technically, this cover is likely not copyrighted. To my knowledge, this street band was never signed to any record company. It was a hobo band. However, to err on the side of caution, any copyright presumably resides with the performers (Jones, Cohn, Wells, Segarra, and Burdick).
- Year: 2005 (circa Hurricane Katrina)
Fair use rationale for Tuba Skinny
[edit]This is a sound sample from a commercial recording. Its inclusion here is claimed as fair use because:
- It illustrates an educational article that specifically discusses the band and song from which this sample was taken.
- It is a sample of about 29 seconds from a much longer recording, and could not be used as a substitute for the original commercial recording.
- It is of a lower quality than the original recording.
- It is not replaceable with an uncopyrighted or freely copyrighted sample of comparable educational value.
- It will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording.
