Basic Law: The Millitary is a basic law of Israel, that determines the subordination of the IDF and the Chief of Staff to the government. The law was legislated by the eighth Knesset on 31 of March 1976, following the conclusions of the Agranat Commission that investigated the circumstances of the outbreak of the Yom Kippur War.


The Law

The law is short and concise, and has only 6 sections and 9 sentences:

  1. The Israel Defense Forces are the millitary of the state.
  2. 1. The millitary is subordinate to the government. 2. The minister in charge of the millitary on behalf of the government is the Minister of Defense.
  3. 1. The Chief of the General Staff is subordinate to the government and subordinate to the Minister of Defense. 2. The Chief of the General Staff will be appointed by the government according to the recommendation of the Minister of Defense.
  4. The obligation to serve in the millitary and the recruitment to the millitary will be as stipulated by law or by virtue of it.
  5. The authority to issue instructions and orders requiring the military will be established by law or by virtue of it.
  6. An armed force outside of the Israel Defense Forces may not be established or maintained except in accordance with law.
