- Strongly dispute, this is the image used in the 9/11 Commission Report, entered as evidence in Zacarias Moussaoui's trial and has been widely used by media, the government and all others as though it were public domain. - Keep. Normally we would not use a non-free portrait if a free portrait is available. But in this case, as in many cases involving al-Qaida members, it's literally impossible to ever determine with certainty what the source or copyright status is. The image on Commons, Image:Waleed al-Shehri.jpg, is tagged as PD because it comes from the FBI. But there is no information about the photographer or the copyright status on that FBI page. Obviously the FBI is treating the image as if it were PD, but I doubt a U.S. employee actually snapped the photo as part of his or her duties. Similarly, the FBI reprinted this image in the Moussaoui trial without attribution, treating it as if it were PD. How should we treat it? It was probably created an anonymous al-Qaida photographer. Does that photographer hold the copyright? Is it a "work for hire", meaning al-Qaida owns the copyright? (Could al-Qaida legally be considered a corporate entity?) Was the photo created in Pakistan, Afghanistan, or elsewhere? How is copyright law interpreted the Waziristan region of Pakistan, where the only effective law is sharia as interpreted by illiterate tribal leaders, or in Taliban-controlled Afghanistan, where the law changed at the ruling powers' whims? These questions show just how ridiculous the issue is. Wherever this photo was created, the "legal system" (such as it was) was not concerned with copyright. The idea of al-Qaida suing in U.S. court is laughable. It's frankly unimaginable that a news service would say "Well, we want to run this photograph, but we would need to ask for al-Qaida's permission." If the FBI treats it as PD, and every news source on the planet treats it as PD, I think it'll be fine if we do too. – Quadell (talk) (random) 17:55, 11 October 2007 (UTC)
