I have asked at NASA, whether this image is in public domain, because it is their work, and received the following answer:
- In this instance, you must seek the permission of the European Space Agency, or ESA, and M. Bule. Only images that are credited solely to NASA are copyright free. Even in that instance, certain restrictions apply.
- Please see NASA's image use guidelines at http://www.nasa.gov/audience/formedia/features/MP_Photo_Guidelines.html for more information.

Therefore I think that the image cannot be tagged as a public domain image, because it was created by NASA, and that it cannot stay here unless the permission of ESA and M. Buie are provided as well. Jan.Kamenicek (talk) 16:08, 29 December 2011 (UTC)
- Works from Hubble made by or for the ESA are public domain or free use, see commons:Template:PD-NASA, but the work by Buie presumably is copyright. —innotata 17:53, 30 December 2011 (UTC)
- As Kheider has pointed out, in this particular case it should be enough, when M. Buie and Southwest Research Institute are mentioned. Therefore I am going to withdraw the copyvio template and agree with moving the file to the Commons. Jan.Kamenicek (talk) 21:04, 30 December 2011 (UTC)
Moving a file to Commons is a good way to get it deleted whether we agree to keep it or not. Unless it's obviously PD, I think we should keep it here. — kwami (talk) 22:23, 30 December 2011 (UTC)
- I've moved it to Commons. In this case, the Commons template PD-Hubble is appropriate, as this image was published after January 1, 2008, and the Hubblesite.org source page contains no copyright mention, which would be present if an author wished to maintain copyright protection on a work released by the STScI. — Huntster (t @ c) 09:50, 31 December 2011 (UTC)
