As explained on Wikipedia:Public domain#Derived works and restorations of works in the public domain and Wikipedia:Fair use#Legal position, "slavish reproductions" of public domain images, no matter how much effort went into the process, does not create new copyrighted material under US law. In particular, a bookseller's scan of a rare book, even though it may have cost him thousands of dollars just to acquire the original, and even if it required extremely delicate handling and photography and image postprocessing, has not created a copyrighted image.
