The result was to delete the image. Wikipedia's fair use requirements are stricter than US law (see WP:Non-free content) and non-free images of living people used for visual identification of the subject are normally considered unacceptable fair use. This image could be restored if the copyright holder(s) would be willing to release it under a free licence; if so please see WP:PERMISSION for further information. The file is a necessary photo-portrait of the artist to illustrate his article. The photographer has given him the copyright to this photo, and he asked to have it uploaded to Wikipedia. — Preceding unsigned comment added by LucLewitanski (talk • contribs)

There is no need to replace the photograph. It clearly falls under fair use as defined in Section 106 of the Copyright Act of 1976. Furthermore, it meets the requirements on Wikipedia for a non-free use rationale, because it illustrates the artist in front of his most notorious work, and cannot be retaken without returning to its location. As an aside, the copyright owner of the photograph, the sculpture in the background, as well as the subject depicted in the photograph are all the same entity, who was expressly given permission for this image to be distributed in such a way. --LucLewitanski (talk) 8:27, 21 February 2014 (UTC)
