Replaceability

Patent pending is not the same as patented, so if that is the case then for now there is no restriction on using the same method to recreate the image. Furthermore, even if the method was patented, that does not mean that a similar image could not be created using a different (non-patented) method. True, however, it is my understanding that if the patent is granted, then the patent holder can seek damages from the time that the patent was applied for. Therefore, it is in everyone's best interests not to infrige. To the best of my knowledge, there is no other way to produce this type of file. These images are nearly impossible to describe in words, and I have obtained every permission necessary to post this file. As far as seeking damages, that only applies once an patent application is published and actual notice is given. Everything I've read only says "Patent Pending" which doesn't qualify. Regardless, those are issues for any involved parties and their attorneys to sort out and generally not our purview here on Wikipedia. Barring some sort of exceptionally broad patent (which without having an actual application number is rather hard to evaluate), substantially similar images can be drawn by hand (or rather, on a computer).

If the images are explicitly released under a free license (following the procedures listed at WP:Donating copyrighted materials, not just for use on Wikipedia) then there would be absolutely no problem with retaining the images. VernoWhitney (talk) 18:22, 10 October 2012 (UTC)[reply]
