Not replaceable with free media because:
This photo is unique because there is only one clarinet of this type in the world. It is a custom-made product from the Schwenk & Seggelke manufactory: a basset clarinet with a modern French fingering system, but in the design of the basset clarinet with which Anton Stadler premiered Mozart's clarinet concerto in Prague in 1792. A sketch of this clarinet can also be found in the article Basset Clarinet.
The photo cannot be replaced because Schwenk & Seggelke did not take a photo of this instrument and because Charles Neidich's photographer is Kevin Hatt and he has no assignment to photograph the clarinet again and because Kevin Hatt has told me that he is not ready is to waive rights to his images in the way that Wikimedia Commons requires.
Conclusion: there is neither currently nor in the future a comparable photo under a free license. --Gisel (talk) 15:37, 21 October 2020 (UTC)[reply]
- There's related discussion about this at User talk:JJMC89#File:Charles Neidich by Kevin Hatt 5a.jpg since JJMC89 is the one who tagged the file with {{rfu}}. As I posted there, I don't think we a need a non-free image which is essentially duo-purpose in that it's a non-free image of Charles Neidich and the instrument, just because the photographer who took the photo doesn't want to release under a free license that Wikipedia accepts. It appears that Neidich still performs and uses this instrument during his performances which means that a free equivalent seems reasonable to expect. Moreover, even a non-free image of just the instrument itself is not certain to meet WP:NFCC#8 (WP:NFC#CS) based upon the bare minimal and unsourced content about it in Basset clarinet#Construction. The photo might be unique, but that's not an automatic reason for justifying it's non-free use per WP:IRREPLACEABLE. -- Marchjuly (talk)
