Summary

[edit]
Non-free media information and use rationale – non-free concert tour poster – true for Franciszek Zachara
Description

This is a poster for Franciszek Zachara.
The poster art copyright is believed to belong to the distributor of the concert tour, the publisher of the concert tour or the graphic artist.
Further details: An early photograph of Franciszek Zachara from a poster / press sheet used around the time Zachara came to the U.S. (circa 1928). Photographer unknown. This is an image from the front of a poster that pianist Franciszek Zachara used in New York and on a United States tour circa 1928-29. The back of the poster contains program information of a specific concert and/or series of concerts given at that time, along with concert reviews of his New York debut. Thus this poster may also be considered to function as a press sheet.

The item in question was produced more than 75 years ago, and is believed to be out of copyright.

Portion used

The entire poster: because the image is poster art, a form of product packaging or service marketing, the entire image is needed to identify the product or service, properly convey the meaning and branding intended, and avoid tarnishing or misrepresenting the image.

Low resolution?

The copy is of sufficient resolution for commentary and identification but lower resolution than the original poster. Copies made from it will be of inferior quality, unsuitable as counterfeit artwork, pirate versions or for uses that would compete with the commercial purpose of the original artwork.

Purpose of use

Section. The image is used for identification in the context of critical commentary of the work, product or service for which it serves as poster art. It makes a significant contribution to the user's understanding of the article, which could not practically be conveyed by words alone. The image is placed at the beginning of a section discussing the work, product or service to help the user quickly identify the work and know they have found what they are looking for. Use for this purpose does not compete with the purposes of the original artwork, namely the creator providing graphic design services, and in turn the marketing of the promoted item.

Replaceable?

As concert tour poster art, the image is not replaceable by free content; any other image that shows the same artwork or poster would also be copyrighted, and any version that is not true to the original would be inadequate for identification or commentary. Using different image would be misleading as to the identity of the work, product or service

Other information

Use of the poster art in the article complies with Wikipedia non-free content policy and fair use under United States copyright law as described above.
