Purpose of use |
Main infobox. The image is used for identification in the context of critical commentary of the work for which it serves as cover art. It makes a significant contribution to the user's understanding of the article, which could not practically be conveyed by words alone. The image is placed in the infobox at the top of the article discussing the work, to show the primary visual image associated with the work, and to help the user quickly identify the work and know they have found what they are looking for. The image serves as the primary means of visual identification of the subject (the book) and the recording. It illustrates an educational article about the CD and book from which the cover illustration was taken.. Commentary in the article about the cover art itself: Cover art was developed by Summit Record and was the final product of three different color schemes and designs. All were about the same graphics but one was reds (final proof used), 2nd was blues, and 3rd was multi colored.. Use for this purpose does not compete with the purposes of the original artwork, namely the artist's providing graphic design services to music concerns and in turn marketing music to the public. |

As musical cover art, the image is not replaceable by free content; any other image that shows the packaging of the music would also be copyrighted, and any version that is not true to the original would be inadequate for identification or commentary. There is no free equivalent of this book cover, so the image cannot be replaced by a free image. The colors, graphics, and information on this image are entirely unique to this CD recording and conver art. |

The use of the cover will not affect the value of the original work or limit in any way the copyright holder's rights or ability to distribute the original. In particular, copies could not be used to make illegal copies of the book. The book is numerous pages and has a great deal of liners notes, copies would be impossible to replicate from this image unless the entire book is accessible from Summit or any other source (which it is not). |
