The photograph is assumed to be in the public domain as the subject of the photograph died over 100 years ago (in 1907) and therefore it is highly unlikely that the author of the photograph to have died less than 50 years ago. New Zealand copyright law states that photographs enter the public domain 50 years after the death of the author. Furthermore, as the subject died in 1907, the image must have been taken prior to 1907 and qualifies for Public Domain in the US as it was published outside the US prior to 1923.

This New Zealand work is in the public domain in New Zealand, because its copyright has expired or it is not subject to copyright (details). According to the New Zealand Copyright Act of 1994 as elaborated on by the Standing Committee on Copyright of the Library and Information Association of New Zealand (LIANZA), as of May 2011:
1 Some government publications are not subject to copyright, including bills, acts, regulations, court judgments, royal commission and select committee reports, etc. See references [1] or [2] for the full list. Such works should use {{PD-NZSection27}}. | ||||||||||||||||||||||||||

This image is in the public domain in the United States because it was first published outside the United States prior to January 1, 1929. Other jurisdictions have other rules. Also note that this image may not be in the public domain in the 9th Circuit if it was first published on or after July 1, 1909 in noncompliance with US formalities, unless the author is known to have died in 1953 or earlier (more than 70 years ago) or the work was created in 1903 or earlier (more than 120 years ago.)[3] |
This file is believed to be out of copyright in its home country, as well as the US. If this is confirmed when checked, it should be copied to Wikimedia Commons.
