Yes |
Purpose of use |
To illustrate an article about an important record in Sun Ra's early career, and in particular to illustrate the contemporary (fairly straight) presentation of the band, as a counterfoil to later images of the band as considerably more outlandish, and to establish a context of lounge jazz performance for the early records. |
Replaceable? |
Most of the key members of the band (Ra himself, Gilmore, etc) are long dead. |

Fair Use Rationale
[edit]- The photo is being used for illustrative and educative purposes only
- As a part of an article on a work of art, provision is provided under US copyright law for the fair use of a photo to help illustrate the actions and works of a historically important artist
- The record featured in the article is a seminal piece that influenced space rock and psychedelia as well as progressive jazz; an important part of the work is its relationaship to its authors political and philosophical views, and his reliance on visual presentation to express those views to an audience
- It is also notable for being amongst the very first independent records to be released by an artist-controlled label.
- As a part of a larger discography, I wanted to show the visual evolution of the arkestra, by placing well chosen images of the band at key points in their development.
- The image is of low resolution, and unsuitable for commercial reproduction
This image represents a two-dimensional work of art, such as a drawing, painting, print, or similar creation.
