The image linked here is claimed to be used under fair use as:
- low resolution image
- no non-copyright version available, by definition
- its inclusion in the article adds significantly to the article because it is the primary means of identifying the subject of this article
- the photo is only being used for informational purposes, in an article which specifically references the subject of the photo, i.e. Joginder Singh himself and the vehicle with which he made his first "notable" achievement;
- a free replacement would be very difficult to obtain; the events in question happened forty years ago, and photographing both driver and car together again would be almost impossible as this was a specially arranged event.
