[edit]It is believed that this picture can be used under exemption of fair use on the article of Malcolm Sargent because:
- it is a low-resolution scan of the cover only of an LP
- it is used as an illustration of Sargent's performances at the Proms, which is discussed in the article
- it is not being used for profit
- use of this picture doesn't limit EMI's ability to sell the Sargent LP, the cover of which this image is taken from
