[edit]This work is in the public domain in the United States because it was published in the United States between 1929 and 1963, and although there may or may not have been a copyright notice, the copyright was not renewed. Unless its author has been dead for the required period, it is copyrighted in the countries or areas that do not apply the rule of the shorter term for US works, such as Canada (50 pma), Mainland China (50 pma, not Hong Kong or Macao), Germany (70 pma), Mexico (100 pma), Switzerland (70 pma), and other countries with individual treaties. Fair use is presumed here, as the Los Angeles Library's Photo Collection contains thousands of similar images that were gathered from abandoned sources such as the former, and literally trashed, files of the Los Angeles Herald Examiner (copyrights which often are still owned by the Hearst family). In such a case, as I understand, where the copyright of the photos had been surrendered to the former newspaper; the ownership just simply goes to the person who now possesses the photo. He does have a right to sell copies of the photo, but there is no longer a valid copyright on the photo or image. Further, this image is low resolution, and is intended for informational purposes only.
In this case, the Los Angeles Public Library hasn't even indicated where in fact hey actually got the photo, which is sad; but I have personally watched as the library personnel have sat down and gone over 100's and 1000's of dedicated photos that persons are more than happy to donate to the library in the hopes that they will be preserved.
Further reproduction in this manner only facilitates the donor's original intention to preserve.
