I (Grandpafootsoldier) have uploaded this image, Papillon_ver1.jpg, here. Though the picture is subject to copyright, I feel it is covered by the U.S. fair use laws for this page alone because:

  1. it is a low resolution copy of a film poster;
  2. it contributes to the article significantly;
  3. it does not limit the copyright owner's ability to sell copies of the film in any way;
  4. no free equivalent is available at this time

Tom Jung

Portion used

Because the image is a film poster, a form of product packaging, the entire image is needed to identify the product, properly convey the meaning and branding intended, and avoid tarnishing or misrepresenting the image.

Low resolution?

The copy is of sufficient resolution for commentary and identification but lower resolution than the original. Copies made from it will be of inferior quality, unsuitable as artwork on pirate versions or other uses that would compete with the commercial purpose of the original artwork.

Purpose of use

For fair use on Tom Jung:

  • It is used for identification and critical commentary of the work for which it was created. The image is being used as an illustration of the artist's work for informational purposes.
  • It makes a significant contribution to the user's understanding of the article, which could not practically be conveyed by words alone.
  • Use of the image does not in any way harm the ability of the companies concerned to sell the work.
  • Use for this purpose does not compete with the purposes of the original artwork, namely the artist's providing graphic design services and in turn marketing films to the public.
Replaceable?

As a film poster, the image is not replaceable by free content; any other image that shows the images from the movie poster would also be copyrighted, and any version that is not true to the original would be inadequate for identification or commentary.

Other information

Use of the film poster in the article complies with Wikipedia non-free content policy and fair use under United States copyright law as described above.
