This is a mugshot of New York mobster, Monk Eastman. The picture is provided by NYPD archives and featured in Herbert Asbury's 1926 book "The Gangs of New York". I believe this picture to be in public domain as all of the images and pictures included therin range between 1840 to 1920's and especially since this is a police mushot.
